I-129F was submitted on 30DEC2013

NOA1 Receipt Number on 8JAN2014

Case is in Initial Review as of today 22MAY2014 and will reach 5 month processing time on 8JUN2014 (Am I right?)

My Fiance is pregnant and baby is due in July.

I-129F Petition does not have new baby listed because he is not born yet.

Thanks a lot if you can answer on the below:

QUESTIONS:

1.

Do I have to do anything now, in advance , so baby can get K-2 visa not being listed on I-129F which is pending?

2.

How does she go via Medical Exams if she is pregnant or even right after the birth ? I know that certain tests like TB test for example cannot be done when pregnant or feeding a baby.

3.

I know about CRBA - Consular Request for Birth Abroad , which could be processed via American Embassy, so that baby receives USC [uS Citizenship] but I afraid this is a long way.

1. Assuming you meet the requirements, the baby will not be arriving on a K2 but on a US passport, begin looking up CRBA for the beneficiary's country.

2. They take those things into consideration, she will be given medically appropriate care for her condition.

3. There is no option, your child has claims to US citizenship, a visa will not be issued.

I take it you are the father. The baby is a US citizen. No visa required. The medical facility is quite good at modifying the medical exam for a pregnant woman, as they do that all the time. But based on the timeline you presented here, the birth will probably occur by the time the medical exam comes anyway.

Thank you to all who answered.

There is no answer of any king from USCIS yet.

I called today and they told me that TX Center is currently working on I-129Fs filed in NOV 2013

They told me that it is estimated 54 more day until they will look at my application....

Meanwhile, my fiance applied for police paper work, hopefully it will go through for the one wiich will be required in addition to medicals.

What is really awkward is that we will have to travel to Moscow to get the baby presented at the time of the application to CRBA.

I do not know how long does it take for the Embassy to issue CRBA and the passport... I would guess it is not going to happen the next day and we will have to come back to Moscow one more time hopefully before the final travel over the Ocean.

canadian_wife Thanks for help, I noticed that you had more than a month gap between Case Completed and Medical. Was it your choice or was it done so by the Embassy dictated time line?

Do you guys know if:

1. My 10 years step-daughter will have to to to the embassy for the interview?

2. Does she have to go to medical exams too?

Yes, if the step daughter is immigrating under K2 she will need all paperwork as her mother - Ds-160, birth certificate, medical. Don't think police certificate is needed though.

Shrm - In Canada one cannot book a medical until the interview has been assigned. So my case was complete at NVC and it went to the Montreal consulate, and when NVC scheduled my appointment I was able to book my medical
