Did anyone got TOURIST visa while F2A is pending?

hi,

Unfortunately, Our cut-off date has retrogressed to more than a year. I'd like to visit my spouse on tourist visa.Can anyone help me out by sharing your experiences? I heard that chances of getting tourist visa at this time are very very low..

I will be going over on the VWP, which I believe is a lot easier than a Visitor Visa, which if I am not mistaken you need, if you are an Indian citizen.

To show proof of ties I will show the CBP officer, my NOA1 and 2 - to show I intend to immigrate the right way, a letter from my employers, a recent payslip and maybe a later from my folks saying I live with them, but they are expecting me back on x date. I know from other peoples experience this is more than enough for the VWP - with the Visa I am not sure, just bring things like I mentioned and maybe a lease agreemenet and any other documents showing you are tied to your home country, e.g you need to return.

I will be going over on the VWP, which I believe is a lot easier than a Visitor Visa, which if I am not mistaken you need, if you are an Indian citizen.

You can always try and apply although there is no guarantee. The consulate can deny it. One of my friend has got tourist visa while her petition is pending. But she did state in the interview that she has already applied for F2A. And ones she/he comes to USA on tourist visa, has return back to her country in 6 months.

You can always try and apply although there is no guarantee. The consulate can deny it. One of my friend has got tourist visa while her petition is pending. But she did state in the interview that she has already applied for F2A. And ones she/he comes to USA on tourist visa, has return back to her country in 6 months.

The Visa Officer who interviews you needs to be convinced that you will return back . So you need to prove really strong ties . Like a good job or enrollment in a college/university could get the visa officer to be convinced that you will return back. And of course, you will need to take leave approval letters from your employer/college for the VO to be really convinced. Having property registered in your name could also prove that you have ties with your home country.In my case I had neither.

About being worthy or not, well I don't know. It's entirely upto the VO to decide. Sometimes you may have a job/property etc. but they may still deny it. And be very honest while filling in the B2 application form. There is a question which asks "Has anyone filed an immigrant petition for you? " Answer "Yes" and below that there is a column where you are asked to explain. I have heard people do succeed in getting it but again I'd say it is varies from case to case.

Thank you cp9! Me too have the same doubts as you expressed...which Indian consulate is better to apply for a B2 Visa, processing time period, can we apply on our own/hire an attorney...
