I-130 Processing time in Nebraska Service Center

Hi

My spouse is us Citizen. She filed I-130 petition on December 2013. It is about 5 and half months now and the current status is still in initial review.

It is in Nebraska Service Center.

How much i have to wait for approval/final decision.

One more thing I am blessed with a baby girl .Can this will be helpful in the process.?

Hi faisal.sial,

The current waiting time for the first stage of the process (USCIS approving I-130) is taking from 6 months to a year depending on the case. You can see this timeline in the USCIS website, under "check your case status." There you can also check the specific status of your case if you put in the number case you received in your NOA1. My case was also sent to the Nebraska service center, but I requested an expedite.

Some cases are taking less than that and others are taking longer. Have you tried to call USCIS and ask about it? You could also try to expedite if you have any reason that fits their criteria. Call them and ask about it :)

Timeline

It usually takes 5-8 months to get the process going. Some times even more. This varies from case to case. So be patient.

Regarding your baby, please see what experts have to say about it.

Nebraska Service Center. is still dealing with November case. i just called them, they said they will start December case after 38 days.

It takes about 7 months. Thats how long it took our to get to NVC. I wonder how come you didn't Expedite the case when your wife was pregnant? That should've helped with the expedite. Good Luck.

They are processing November 6 cases huh? that's my priority date I think. keeping my fingers crossed that I'll get the NOA2 soon

I have seen Nebraska switch from 9 months down to 5 months now for processing time. I wanna know how I can expedite. in 3 days it will be 3 months they have had the application which is not long. I just dont want it going 7-9 months like I have heard. What qualifies for an expedite and what form can be filed to accomplish that? Thanks in advance to anyone that can answer it. I'm an american living in Dominican Republic with my wife I have been married to for over 2 years now.

yeah i saw that to... from 9 months down to 5 months, but i think the time frame isnt accurate. or they just like to mess with our heads.

when we called last monday ... and explained our case is over the 5 months they said that we have to wait untill the case is 6 months , and then you can file for an e-request.

your question about expedite , here is wat the website from USCIS says about it,

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

Note: Discretionary expedite requests for petitions and applications that have Premium Processing Service available will not be considered for expedite processing. The only exception is when the petitioner is a not-for-profit organization designated by the Internal Revenue Service. For information regarding premium processing, please refer to the premium processing webpage.

If you have already filed your application or petition:

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.
