My fiancé lives in Mexico and we have been together about three years. I want to bring him to the United States so I met with an immigration lawyer who said the best option was a K1 spousal visa but I keep hearing that a K3 fiancé visa is the better way to go. We were planning on getting married in Mexico in November of 2014 but now I am not sure what to do.

Also, how hard is it to do the visa application yourself? Do I REALLY need to pay all those legal fees to get the process done? Thank you for any help you can give me on the subject.

Thank you David & Zoila. Hoping for someone to explain to me in laymen's terms instead of sending me to links? I've read the differences between both visas but I am still confused on what to do?

The guides are in simple English lay mens terms. If you read the you will understand them. Trust the instructions and you will be fine. On the other hand if you prefer you can spend a few thousand dollars on an attorned and he can read the instructions a fill out the form for you. It's up to you. I was just trying to be helpful. Good luck.

That is where the yourself come into play in the DIY (do it yourself).... K1 is fiancé visa.... CR1 is spouse visa... Both can be done without a lawyer unless the case is complicated ( if there are overstay issues, criminal background etc) ... Or if someone had difficulty reading and understanding instructions.

There is a topic k1 vs. CR1 that you might read to compare which one is best...

if you are on a handphone and viewing things,

turn it off,

come back on a PC,

revisit the Guides Section again

and click on the 'BEGIN HERE:' link thingie.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

K1 is faster, but more expensive and they cannot work or travel for 90 days after marrying... CR 1 is longer but GC is given upon entry... 5-9 months for K1 vs. 12-15 months CR1. Criminal background of petitioner (USC ) does not matter unless the crime involved a child or sexual offense.

Since we aren't married yet...I can technically do both. I just don't know which one is better?

This is somehting you have to decide for yourselves based upon information that we do not have. Hence the guides...
