Where to file 129 f if living abroad

Great thank you. I was planning on doing that. I just need to figure out the fee. I have the money but can I do it online or wire it?

Did you read my original post? I said I CONTACTED the embassy. Yet another reason I am asking here is because the embassy here in Turkey only spends 2 hours per week answering questions on immigrant visas and whenever I contact them during those hours I cannot get through. So please stop assuming that I have not read the instructions and copy and pasting things. Rudeness is not appreciated.

Listen I just was unclear about what I had read so I came here to ask a few clarification questions. Please be respectful.

Hi Icechamp, there is some confusing misinformation in this thread.

You will mail the petition to the Lockbox in Texas, as it states in the instructions.

You will need to use a check drawn on US funds. Maybe you can send the package to your parents and they can add a check and send it on. Or you can find a foreign bank that can draw a banker's check on US funds.

Then you will have time to wait and figure out the next steps.

Domicile usually isn't an issue brought up for K-1s, so I am not sure why there is so much discussion of it. They do this for spousal visa, so it might be a good idea to be aware of it, but it is something that comes up at the interview stage, down the line. They might want to know that you have solid plans to move back to the US. Don't try to hang on to using your parent's address to prove you live in the US. Obviously you don't, and that is okay. Just show them the plans you have made, by then, to move both of you to the US.

Also later down the line, you will have an issue with the affidavit of support because you live abroad. You will probably need a co-sponsor with a job in the US, or assets to complete the affidavit.

But for now, concentrate on the I-129F petition, the first step. Good luck.

Most Embassies respond better to emails rather than phone calls.

There is no online payment method, check drawn on US bank funds is the only payment method. Make sure the check is addressed (Payee) correctly.

Every immigration method requires an affidavit of support. The US gov wants a sort of guarantee that the immigrant will not take welfare from the US.

As I said, that comes later, at the interview. If you have money saved up then you can use that, if it is enough. You will have time to research the requirements.

I am sure your family is great, but everyone has to comply with this requirement.

He won't be able to work for a while, FYI. Once you get the visa, then you have to come to the US and marry in the US, then file an adjustment of Status package ($1070). WIth that package, there will be a temporary work permission that is free, and he will need to wait around 3 months for that to be approved from when you apply. So prepare that he will have a free months of down time in the US, unable to work, unable to drive, unable to travel abroad. (time until marriage + time until AOS submission + 3 months).

Unfortunately, the US does make it rather cumbersome to bring a fiancé/spouse into the US. They do this because of fraudsters who will marry an American just to get the Green Card before they disappear into the ether, leaving the US citizen worse for wear. I'm not at all saying your fiancé is a fraudster, but it is an assumption you have to overcome when you file for the visa.

This is why you need the affidavit of support requirements to be met (to prove to the US government you can afford to keep your partner without him claiming welfare), and at the interview stage (or I-129F stage if you wish), you should take/submit proof of an ongoing relationship.

If you read the guide at the top for the K-1 visa, you should get the gist of what you need to do. There are also wikis here that explain steps you can take to prove your intent to re-establish US domicile, if you don't move back there before the interview.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I'm living in England at the moment but moving back to Texas in August. I had my mom help me out because it says you must file inside America. I sent my mom everything and she filled out the co-sponsor page i needed. She included mine and her bank statements and tax returns

What i did is that, i said im not surrently living in America but will be moving back soon.

Oh, and shes has right to my bank account while i was over here so shes using my funds for the check.

This is an insane process. I am just lost with all of the steps. It is incredibly overwhelming

I know exactly how you feel :( that is how I felt when I first looked into all of this. You need to take each stage one step at a time or it's just way too much to take in. You don't have to file right at this second, so even if you just take a week out to read and understand the steps, it will help.

Thanks. At least some people are being nice. I dont understand why some people were assuming I didn't even read the instructions. The empathy helps. Its just crazy
