I know this is a little pre-emptive but: if my husband is missing vaccines, can he just get them at his medical? Also he lives in Nova Scotia, so it is possible for him to have his medical + interview close to each other, right?

It takes a few days for the medical results to be ready, and I'm sure someone here can elaborate on their Canadian wait-time for results.... but I also will likely book my medical and head to Montreal at least 5 days early so that I have my results in time for the Interview, and only have to fly once. sleep.png

Okay cool, but he can have his medical close to his interview right? Because he only wants to fly to montreal once :x.

Medisys needs 3 days after the medical date (so 4 business days total - no weekends or holidays) to get the results back from them. If you book on Tuesday afternoon, expect the results late Friday afternoon. I got mine just barely before they closed and my interview was Monday am. I suggest going earlier in the day or give an extra day in there to be sure. Also for any vaccinations you can a) get your blood tested by your doctor to see what you have immunity for (you only need it it for MMR, Tdap, Varicella [chicken pox] and right now the flu shot.) and then go to your health clinic and get the ones you're not immune to for free OR b) pay for them at the medical which is about $25+ per shot. I suggest doing it the free way.

I am $1300 away from the poverty line sad.png However, my house is paid up, no mortgage. I also have around 40K in my saving and checking account. Do they count bank account as assets.

yes, they allow assets... you need i think 2 /3 / or 5 times the shortfall in assets... either way you are covered since you have 40k in liquidity.... just be sure to read and document clearly on the 864.

Sooooo. My husband has asked his tax accountant to prepare his 2013 taxes as 'married filing separately'. They were thinking for 2 weeks and said we'd need to obtain a tax ID for me and file my taxes for the last two years. Eh?? I'm not even a resident yet! Any thoughts? Advice? Would be greatly appreciated.

I've perused the irs.gov site some time ago for how new residents are supposed to file and it appears they're starting to file with the year they arrive on the immigrant visa.

when were you officially married ? i was married in 2013, so i only need to file married for 1 year. My wife does not have a SSN# so we are filing a w7 to obtain her ITIN and we include her income but take credit for her taxes paid. filing seperately depending on the income levels is horrible for me... so i am filing jointly and saving about 12k in taxes... the first year i have to file on paper and mail to a location for us.

i would question why you need to file for 2 years.. that means you need to open up the 2012 taxes your husband filed and amend them... then you need to re-order those transcripts... and have all that ready before you get to the NVC stage for AOS.

you can message me or just quote my text and i will reply... i know tax rules fairly well.

We got married in Nov 2012. He will get his taxes adjusted as MFS for 2012 as well. I am already on the NVC stage as you may notice from the thread we're in. Heh.

My question was: why do they need to file MY taxes if he is filing MFS and i'm not a legal resident there yet?

I'm the beneficiary.

You do not.

Thanks, that's the answer i was looking for. I think they (his tax accountants) don't have a lot of experience with such cases and are fairly confused.

I'm the beneficiary.

Your interpretation is correct. She is non-Indian and lives outside of India. The bullet points I gave was directly from NVC checklist email. My attorney called and the issue was resolved over the phone. In fact, my case is now awaiting interview date.

I have heard disaster attorney stories on this forum and others, but when you hire a competent and experienced one in this field, you are not disappointed. Hooray to my attorney who got everything right. In fact, he had explicitly emailed me about the Indian Police Certificate issue before we sent package to NVC and how I did not need it for my wife. All's good!!

Uffff! Glad to hear all is good! :)

I was looking for some help on the income portion of the 864EZ. I have seen many people have issues with mismatches that cause checklists or RFEs.

Per the instruction it mentions that state the income you are using to meet the requirement for this form for part 18-'My Individual Income Currently', for this I want to put the exact amount from my w-2 from the last year which is sufficient to meet my requirement. Plus since I am filling out I864-EZ I can only use my w-2 income. However, during that tax year I have additional income from capital gains and other items. So now, when I fill out the next part 'Federal Income Tax Information, Total Income' section I would think I should put the total income w-2 + other incomes. This will lead to a mismatch Individual income and Federal tax information for the last year.

I am afraid that this mismatch might cause issues that I have seen others report. Is this an issue? Has anybody ran into a similar issue?

TIA.

Hi everybody, good to see some folks here from the April thread... can't wait to have them all join here!

I have two questions if you guys can help me get clear on these two:

1. I-864EZ - the infamous question 19 - do I have to enter the numbers for agi for all past three years if I select that I only submit the last year of taxes? And is that truly a choice as they say (optional) i would hate to get a checklist for that....

2. Taxes - I did mine as Head of Household - for which I am considered unmarried as per the IRS guidelines and i have a child who's my dependent. But from what I read here i got a little freaked out about this seeing the argument about the married vs single. The option head of household doesn't say anywhere that I claim to be single so I just wanted to see if anyone has any thoughts on this?

here is the excerpt from the IRS publication:

http://www.irs.gov/publications/p17/ch02.html#en_US_2013_publink1000170797

Considered Unmarried

To qualify for head of household status, you must be either unmarried or considered unmarried on the last day of the year. You are considered unmarried on the last day of the tax year if you meet all the following tests.

  1. You file a separate return (defined earlier under Joint Return After Separate Returns ).

  2. You paid more than half the cost of keeping up your home for the tax year.

  3. Your spouse did not live in your home during the last 6 months of the tax year. Your spouse is considered to live in your home even if he or she is temporarily absent due to special circumstances. See Temporary absences , under Qualifying Person, later.

  4. Your home was the main home of your child, stepchild, or foster child for more than half the year. (See Home of qualifying person , under Qualifying Person, later, for rules applying to a child's birth, death, or temporary absence during the year.)

  5. You must be able to claim an exemption for the child. However, you meet this test if you cannot claim the exemption only because the noncustodial parent can claim the child using the rules described in Children of divorced or separated parents (or parents who live apart) under Qualifying Child in chapter 3, or in Support Test for Children of Divorced or Separated Parents (or Parents Who Live Apart) under Qualifying Relative in chapter 3. The general rules for claiming an exemption for a dependent are explained underExemptions for Dependents in chapter 3.

And finally for purposes of the spreadsheet do I need to fill it in or is Saylin doing that? My AOS bill came 2/11 together with the DS-261 email. I did both the same day. The AOS fee shows paid as of today 2/15. I'm working on sending the AOS package next week.

BTW: NVC got my i-130 and i-129 on Jan 7, i-130 case assigned 2/11. Just for farts and giggles NVC sent my i-129 to my embassy back on jan 10, and told me on the phone that I need to call the embassy and ask them if they will process my K3. I called the embassy and they said no because the i-130 was approved at the same time. So I had my hopes up for a moment. Why it took a month to log in the i-130.... well we all know..... rolleyes.gif

Any feedback on that question 19 and taxes is much appreciated!

1/7/14 - NVC received I129 and I130
