I had no idea about this website and have been trying to accomplish everything with information i've gotten directly from the Government agencies and they are little to know help.

My fiance' came here October 12th. We were married January 5th, The I194 expired January 9th.

My understanding was that I needed to marry her before applying for the SSN. So yesterday we went to the SS Office and were told we could no longer apply. The agent there said we now needed to wait for her Green Card.

I called the national SSN toll free number and after an hour hold time reached a lady that told me there was no possible way my fiance could get an SSN at any point in the process without becoming a US citizen first. I told her this was not true and she hung up on me.

I called USCIS and the agent there told me that the SSN Office agent could have, and was supposed to have, filed a form G845 directly from the SSN office to the USCIS and they could have confirmed her status and we would be able to proceed.

At this point, Id like to get her SSN as quickly as possible because she is sitting at home bored off of her butt.

What is the REAL process from this point?

What is the REAL process from this point?

Even if she has SSN but doesn't have an EAD (this is an authorization to work) she still can't work since she came in a K1 (fiance) visa.

When you apply for green card you can include the EAD and AP (for traveling outside US while green card is in the process) and both will be free of charge.

The EAD and/or AP will approximately come after 3 months if filed with your greencard (I485). You can apply for your greencard,EAD, and AP without SSN.

Your fiance will still have to wait 3 months from when the EAD has been filed before she can work.

as for me, i was able to get my SSN after i got married ihere in California. I just presented my passport, I-94 (which is about to expired in 2 days at that time) and marriage certificate. i think it depends on what state you are and how they process the application.

Hi tuck...Your wife could have applied for a SS number anytime from about a week after she arrived in the U.S. until about two weeks before her I-94 expired.

As others already said, now she'll have to wait until she gets her work permit (EAD) or her green card.

Married first or not, someone that entered with a K-1 is eligible for an SSN. You must apply while the I-94 still has at least 2 weeks left before it expires though.

You were given a lot of misinformation. I am still amazed at how many SSA workers do not have a clue about the info/requirements pertaining to doing their own jobs. Of course you do not have to be a citizen first. How do all the permanent residents work legally then if they are not allowed to get an SSN. Blatant ignorance annoys me. Okay, sorry, back to your situation now.

File for AOS. File for the EAD and AP at the same time. When she receives her EAD/AP card, then go back to the SSA and apply for the SSN using that. The EAD/AP takes about 2-3 months after filing to receive.
