Hello,

My fiance is british, and I am at the first stage: I am filing the petition for the K1 visa

Do I include the affidavit of support of my own and my co-sponsor at this time?

Is there a definitive list of what to include in the petition package?

Thank you!

Claire

The petition will be the 129f. Follow the guides and sample forms here on VJ.

No, you don't include it when you mail in the petition. She/He will take that with them to the interview. And if you have a co-sponsor they'll take your affidavit of support and the I-864 for your co-sponsor with them to the interview.

No, the affidavit of support is used in the next stage of the process, after approval of your I-129f petition.

They will not use the I-864 for the K-1 interview at all. It will be the I-134, even for co-sponsors. Very few consulates ask for an I-864 for a K-1. London is definitely not one of them. In fact, London will not even need an I-134 from the USC petitioner. They will accept the I-134 from just the co-sponsor alone.

@jay-kay - thank you, so is it redundant then to include my own I-134? or should I just do the co-sponsor.

also, if you know, the co-sponsor is a husband and wife who own their assets and make income jointly, do they each file a I-134?

Does having a joint sponsor weaken your case at all?

I see the link about what to include in teh 1-129F initial petition, but right under it - there is the "proof that youve met in person" photos, tickets etc - that doesnt go in the package until the actual k1 application and the interview, correct ?

There is generally no combining of incomes with the I-134. However, you could have them each fill out an I-134 for London to present their joint holdings. Someone that knows the ins and outs of London would be able to answer better. Try asking about it that specifically in the UK regional forum.

You MUST include proof of having met in person within the 2 years prior to filing if you want to have your I-129F petition approved. That is one of the main requirements. You must both be legally able to marry and have met in person at least once in the previous 2 years. You do not need proof of relationship until the K-1 interview. So, proof of meeting for I-129F and proof of ongoing, bona fide relationship for K-1 interview. Those two things are not the same.

"1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years." <- You need this type of evidence. Add in a few photos of you two together too.

Yes, you all are absolutely right. Sorry for the mis-info I perpetrated! I meant to say I-134 for both petitioner and co-sponsor at the time of the K1 interview. The I-864 comes after they get here and you apply for adjustment of status.
