Hello VJers'

I am hoping someone can help us with this K1 process. Fiance was interviewed October 10th and was approved. Was told to go pick up VISA in 2 days but was later called and was told he would be contacted, this was due to RAMADAN/EID. It will already be 3 months this coming January 10th, 2014 and I or we are worried that we have not received not even a message for information. CO told fiance to come back in 2 days as previously stated but to this day we have not heard anything. It is so useless to call consulate since I am always being put on HOLD, transferred or they do not answer and calls are so expensive.... I am always getting the run around and have not and more than likely will never get that phone line to inquire as to reasons why my fiance has not received his VISA...His status on CEAC is AP, again, numerous emails always say same thing and I believe it is an automated message.

Has anyone ever been in this situation? I even resorted to sending email to my fiance in Morocco so he could deliver by mail to consulate to see if we can at least inquire as to reasons or answers. They have told my fiance to wait 3 months but what will happen if the 3 months expire and still no VISA in hand? Again, I am relying on anyone out there that might have gone through this situation and or process... Thanks in advance...

have they been holding your fiance's passport ALL this while?

K1 (I-129F) petition filed in August 2013 (Approved Feb 20th 2014)
13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

THanks for responses but contacting congressman will not help, they just use whatever is in the website as has been the case previously. Also, yes, they have been holding his passport all this time and this is what I seem not to understand. Yes, I have read where AP can take 60 or more days and as told to fiance (morocco) when HE called, to wait at least 90 days but what IF it is not issued, then what? I am so worried that this visa will not come true for as. This is the 2nd time I file, 1st time we were put on AR and so the 2nd time was approved, or was it? I am so hesitant in being positive, this is holding up so many plans since his interview was approved for VISA and it is so sad that these people do not seem to understand they hold people's happiness in their jobs. Now, I am thankful that they do the type of processing that they do, it is their job but sometimes they take it to the extreme and again, do not get me wrong, they take it to the extreme and rightfully so but again, it is holding our plans to marry and start our lives together as a couple as we have been for years...

All I can say is to stay positive they have the passport so eventually it will get issued. Did you ever call DOS here in the US you wasting money calling the embassy on long distance call DOS they can tell you better. Stay positive they have the passport. Good Luck

Absolutely, staying positive is the way of survival with these type of situations, and thank you for your encouragement. I have called DOS and again, an automated answering system that says either inquire after 60 days or simply wait because processing may take longer. Also, they say that same information can be found online and that is where I check daily. Thanks for your response!

Is it possible for the petitioner to schedule an Infopass at the Local Office to speak to a live person to see if they can track the case? Just a thought.
