Hello all,

I am applying for a tourist visa for my sister. She was green card holder before and then moved to India for good. I was wondering if this will have any affect on tourist visa approval.

yup, as she has shown prior immigrant intent .

see, when interviewing for a tourist visa, the Vice-Consul assumes, by USA LAW, that anyone applying for a tourist visa has immigrant intent.

It's on her to prove up otherwise, during the interview.

Hello all,

I am applying for a tourist visa for my sister. She was green card holder before and then moved to India for good. I was wondering if this will have any affect on tourist visa approval.

Thanks.

Unless she is a minor and you're her legal guardian, you can't apply for a tourist visa for her. She must do it herself, as she will have to show proof of ties with India and strong reasons for her to return home after her visit to the US.

Her former situation as a LPR should not affect nor alter the outcome one way or another.

She has demonstrated prior immigrant intent by formerly holding a green card, so may need to show more ties than an average Indian citizen would.

Thanks for replies. Yes, she herself is going to apply for visa. My mother was former green card holder as well but when she went for visitor visa interview they asked her to renew green card. I am not sure what the process for green card renewal in case if they tell the same to my sister.

There is the rub as both your Mother and your sister abandoned their GCs. It sounds to me like they are saying what the above posters are saying which is, "You are not getting a tourist visa to the US because you HAD a GC. IF you want to go to the US then get another GC." Which would require a relative in the US to petition for them as there is no way for them to just renew their GC.

Your sister can try for a tourist visa, but I would suspect that she will be paying for a denial--I hope I am wrong.

Hello guys, I just wanted to update on this so that someone in the same situation can benefit. My sister attended the interview on Monday and I am delighted to say she got the visa. They just asked her why she was abandoning green card and that's about it.

somebody who abandoned their GC would be an excellent tourist visa candidate...after all, they already possessed their permanent residency...why would they (in most cases) turn it in, then apply for a tourist visa just to stay put in the US?

that's one opinion. There are others, and the Vice-Consuls doing the interviews usually use those opinions, per the Field Adjudicator's Manual
