Marriage before SS what you think ?

Hello VJ's

hope everyone is OK :) ... i have few questions .

1- Is it OK to get married once I get to u.s.a through the first 2 weeks before applying for the SS ?

2- Can i send the AOS & EAD also through those 2 weeks after marriage and before applying for SS ?

3- If i got the marriage certificate with me when applying for SS it will help me in what ?

1) Yes.

2) Yes. SSN is not required to file for AOS. As long as you have a copy of your certified marriage certificate from the court, then you can go ahead and fill out all the forms and file.

3) They might go ahead and give you your SSN in your new married name, if you are changing your name, Most of the time though it is easier to apply for the SSN in your maiden name and change it later when you have the green card in your married name.

If you do get a SSN after you're married, it's probably better not to mention you're married and apply in your maiden name, and take the print out page from the SSN guide on VJ to prove you're eligible. A fair few people get the unlucky people who don't know what they're doing, and insist that if you're married on a K1, you need a K3 visa and can't get a SSN. Easier to avoid the hassle.

What does matter is the k-1 visa and the I-94. However, most SSA clerks are braindead and were asleep during their training sessions.

if you are talking about a marriage certificate, are you worried about 'married name' and are you a female ? If yes to both,

instead,

I suggest you only apply in VISA name, then have the name changed with SSA later, after you get the first SSN card, when you have the EAD or green card in your hand. SSA clerks are dumb, stupid, and if they cannot find the name you used in the SS-5 application in the SAVE database, they will send out the application to be verified at DHS, which will take anywhere from 3 days to 9 weeks, depending on the staff there at the SSA office.

So, since an SSN is such a big deal, you should apply in VISA name .

Yes, but the county clerk here said my wife needed the SSN # to apply for a marriage license YMMV

Yes

If you want the SSN in your married name, bring the marriage cert. but be aware it might create a name mismatch, and the SSN clerk may make problems for you. Most people seem to have smoother sailing by getting the original SSN in maiden name and changing after you get the green card.

thanks a lot .. but .. I'm little confuse about changing names I'm Male and i really don't understand this step .. why i change my name ? i will use my same name at all forms from SS and EAD and AP and AOS ... same name as on my passport and my visa ..... so why i have to go back to SS office and change it again ?

YMMV, but if I had to do it all over again, I would have gotten her SS first before getting married. The local SS clerk (Glendora, CA) declined her K-1 because it "expired once you got married." So we had to wait until the EAD card before reapplying.

Yes, as a male, this makes no difference for you. You do not have to worry about changing names and listing maiden name on forms. Your name remains the same on all the forms and you never need to change it. It is easier for males. smile.png

I was told that in my company (not sure if everyone is the same or not) that insurance benefits enrollment periods are waived for spouses and children. Of course they were adamant about getting her SSN before enrolling her in our insurance, so waiting almost 2 months for that sucked, but it's all done now. Only thing we have left to do is actually file the AOS which we are filling out paperwork for now.

Married on November 9, filed for AOS, EAD, AP on 11/14, applied for SSN 12/30. Took a chance, applied for her in married name. Clerk handled it no problem, I think she was competent in her job. She said that when my wife gets her card, she can work. (No waiting for EAD?) Also said 10 days to receive the card. We shall see.

K-2 visa holder, now 21, must wait for EAD to apply for SSN, according to her. According to VJ timelines, should be here January 16-18
