Hi everyone.

My wife (the petitioner) is filing an adjustment of status for me (the beneficiary). She is a student and does not make any income so her mother (my mother-in-law) who lives in the same residence with us and her sister who lives in a different residence are filing the affidavits of support for me. I understand my mother-in-law by virtue of her sharing the same residence with us is a Co-sponsor and her sister is a joint sponsor. Now my question is -

(a) On the Form i-864 that my wife's sister is filling out, what will she answer to Part 1 Question 1. Is she one of two joint sponsors OR she is the only joint sponsor??

I ask this because my wife's sister is a joint sponsor but I don't know if her mom is a co-sponsor or a joint sponsor

This has been bugging me the entire day. An answer will be greatly appreciated. Thank you in advance

First of all, your wife does not file for you. You file for your own adjustment of status. You are no longer a beneficiary, assuming you came here on a K-1. You are now the applicant. All the forms are for you to fill out, except for the I-864 that is needed from your wife as your petitioner and primary sponsor.

There is no point in using both the household member to combine incomes with the USC and also a joint sponsor. If your wife earns no income, then no need to have a household member fill out an I-864A to combine incomes with hers to meet the requirement. She has no income to combine with. If her mother makes enough to meet the requirement for her own household plus you, the foreign spouse, then she should fill out her own separate I-864 as the sole joint sponsor. You can only use one joint sponsor. If the mom does not make enough, then use the sister instead, if she makes enough to meet the requirements. Read over the I-864 instructions and the poverty guidelines.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

since they cannot combine income, I'm not sure if there is any use in having 2 joint sponsors

her mother has to make enough to cover herself, her family and you

the same for sister, both of them have to meet the 125% over the poverty guidelines

the reason for the i864A is to combine incomes, but since your wife doesn't make any income at all, there is nothing to combine with her mother

so she would have 2 joint sponsors, and each of them have to meet the poverty guidelines on their own

so it would be better if she had only one joint sponsor who meets the requirements
