AMERICAN WITH DUI VISITING CANADA

I am Canadian and my boyfriend is filling out the temporary resident permit/visa application has he has had his 1 free visit earlier this year and the website is a little confusing and no one at the conuslate in Los Angeles was able to help him. When submitting it do you need to attach any details about the DUI/charges or is that upon an officers request? And do you mail this directly to Canada or to the consulate in Los Angeles first?

Try calling and its all automated and tells you to visit the website but the website isnt very clear because it tells you you dont need a visa if your American and isnt very case specific. If any one has some advice or even links to helpful sites it would be much appreciated!!

The problem is Canada is the only country in the world that treats a DUI as a felony and not a misdemeanor offence. With that, anyone with a DUI that is not already a Canadian citizen is in-admissible unless they go through another process to waive that. I don't recall what the name is, but you can research that. It takes quite awhile from what I've researched and can be costly, though that form will allow someone with a DUI enter Canada. As for temp residency, I feel that too will fall under the same category and he will be inadmissible. It seems he lucked out crossing over before, but if the border checks up on his records which they do have access too and discover that, then he'll be denied entry.

You'd think it would be places like Saudi Arabia or Oman that would have these strict rules about alcohol, but nope, Canada is the only country that has this stipulation. So you will need to do your research on this matter...

My fiance has DUI and he visits me without any problems. But we read a lot of stories when people came here and were denied to enter Canada, especially if you travel here by car. If it's by plane then normally everything is ok.

we had no issues with previous visits...last Friday out of the blue, he was turned back at the airport and put on the next plane home for an old DUI. No guarantees, but once warned, the flag is there.

Thats the thing--1 can enter many times with NO issues...then that 1 time when ur not expecting any issues--they deny one entry!!

I believe if its over 5 years they usually let it slide, and the form you need is $200 but its a little confusing which is wjy I was wondering if anyone here had any info because the website isnt very helpful nor is the embassy itself in LA lol..

Yes, they don't always ask, but if they do or they pull up the records as the US and Canada share information like that, and they see his past, then he'll be denied unless he applies for a waiver. It's just playing roulette, you never know when they'll inquire about it, even though they should be always asking, they don't always do so...

Interesting to hear Canada being compared to Oman or Saudi Arabia for having strict DUI laws. It's all draconian until it's your loved one who is involved in a car accident with an idiot who thinks drinking and driving is safe. I am glad our laws are strict in this regard.

I know at least two American/Canadians who have that on their records and I can tell you that they have never been happier having dual citizenship and a Canadian passport when going back to Canada as they cannot be denied or turned back as they are also Canadian and so they won't ever be asked about it...
