FOIA request for lost I-130 file for sister

Hi all ,

I wanted to know if anyone knows how to fill this form out. I'm kind of confused.

On part I Type of request I put FOIA u.s. citizen and requesting documents other than my own records.

Part 2 description of records I put other -copy of records for I-130 for sibling.

Purpose : I filed for I-130 for my sister in 2006 and I haven't received anything from
USCIS. Then it asks for the names so I put the petitioners and on the part for family member I put the sisters name and info

Part 3 asks for subject of record consent to release info.. Whose info do I put the petitioners or the beneficiary since beneficiary isn't here and they ask for signature. Beneficiary not in country

PArt 4 Verification of identity Whose? petitioner or beneficiary also needs signature

Part 5 requester would be the petitioner of course.

When you say you received nohthing what do you mean? Did you receive the initial I-797C (What we call NOA1) that has where it was sent and receipt #?

Petitioning siblings is about a 10 to 12 year wait. What does USCIS say when you call.

Guess was just curious wht you are requesting this information?

actually its for my friend. He made an info pass appointment and immigration officer said his name was the only name in their system, no sign of his sister. They gave him this form to fill out FOIA. IM TRYING TO HELP HIM.

WOW. Waiting all this time and nothing. Poor dear.

Part 3 asks for subject of record consent to release info. Consent of Petition. The I-130 is the citizen or LPR requesting of the USCIS to petition their relative.

Everything is about petitioner yes. Notarized I have no idea but I would just to be safe.

thanks dwheels I appreciate it. Yes all this wait and nothing, I feel bad and he should have tried to find out whats wrong from the start since he says he never received anything from USCIS

But before he does all that tell him to call back to USCIS( I bet he just talked to whoever answered the phone and they have no info).

He needs to ask for a Tier 2 Supervisor. That supervisor will be able to look him up and have receiot numver or tell shim what happened.

This could have been a case of the petition returned and not delivered or the I-797C not delivered.

Tell him to call ASAP. Can you keep us posted. Maybe someone will come along and find out something.

Also its been 7 years has he moved since he has filed?

wrong form, the foia is to check immigration records, immigration history

it has nothing to do with forms

do you know if the i130 was approved? you can only get a copy of an approved i130.

for that you will need the i824 form

you can download it at uscis.gov/forms and look for the i824
