you have started this topic before, your husband has a job offer. It is fraud to come to the US with a visitor visa with the intent to stay and adjust status

I didn't read anything about a job offer, just that the tourist visa would be quicker than CR-1, but be used to adjust and stay, but yeah, still totally fraudulent. And, like, haram.

Salaamu aleikoum,

My husband doesn't have any job offers. I just asked "IF" a relative of mine that has a business could give him a work visa? And in this thread, I asked about tourist visa. Sorry, I didnt know asking questions about how to get our loved ones over the States is fraud?! But if work or tourist visa is fraud, then fine of course not something I want to get into. How would I even know if it's fraud or haram? Obviously why I'm on VJ to ask these questions ...

For every spouse that is in a high fraud country that somehow has a tourist visa and then abuses it to sneak in and stay it means that hundreds of other couples have no chance of having a tourist visa where their only wish is to see each other for a few months of this hideous process.

This will not be over quickly. You will not enjoy this.

Wa salaam

You specifically said, in the two threads that got shut down by mods, that you were asking about work and tourist visas because the actual visa that's appropriate to your situation takes too long. Visas don't work like Burger King, where you can have it your way. Unless he is really truly most definitely absolutely just visiting, which everything you've posted recently says that isn't the case, then get in line like everyone else is/has done.

I'm sorry but I obviously know it's not Burger King and we don't get things how we want them. But my questions are all geared towards transporting my family from here to there, with the hopes of not being seperated for long. Since I do have a legit marriage and family, that would be goal. So by asking questions, I don't think I'm doing anything wrong ... Anyways ...

So having a legit marriage means it's ok to commit fraud and bypass the normal visa process that everyone else has to go through? I think everyone in this forum would argue that they also have a legit marriage/relationship and also would like to be together ASAP. Deciding to live in your husband's country and having several children is a decision you chose to make knowing full well that if you decided to move to the states you would be separated for awhile. You're not new to this site. You know this information. Feigning ignorance doesn't equal not knowing the rules.

Henia, I'm going to be honest with you. Please don't take a chance with the tourist visa. It could work but it could also go terribly wrong. If anyone even thinks you're trying to bypass normal visa processing, you're husband will get slapped with a lifetime ban for fraud. This is a ban my own spouse had( under diff circumstances), we fought and we won. It would be very difficult for you to fight since you've lived in Algeria for 7 years. The basis for getting it overturned is not being able to live in applicant's country OR in the US without them. The fraud finding can happen at the interview or when you all try to enter the US. If it happens at the airport, he will be returned to Algeria and you have a deportation ban to fight as well.

My advice is to find a trusted friend in the US willing to sign the affidavit of support for him. Stay in Algeria duting processing and come to the US together.

Also, don't forget USCIS and/or embassy people know about VJ and visit it. I'm sure that since there is probably a relatively low number of people where the USC wife has lived in Algeria for 7 years and now has 4 kids... they can and most likely will know about this conversation and the idea that the legitimate way will "take too long." My recommendation is always to not commit fraud... but even beyond this, it is highly likely that they will see this and know about it and it'll bite y'all later on.
