Timeline

Hello everyone! I have some question:
I am greencard holder and received my green card through my x-wife in 2010. I remarried right after divorce (year 2013) was final. I didn't have any income for year 2012
What can I do? How many years of income do I need to applay for my wife to migrate to united state?
How much income we have to show? Can my wife sponsor herself?

If you got your current green card from marriage to a USC there is a 5 year wait before you can apply for an I130 for a spouse ( see the instructions under who may not use this form ) you can waive that time if you can show that your first marriage was bonefide. However they will look vary closely at your new marriage so close to the old one. Also you need to make 125% the income shown on the federal poverty guides. The current income is most important but many years shows income stability.

This will not be over quickly. You will not enjoy this.

Just because you receive your greencard doesn't mean the relationship was bonafide. It doesn't look nor sound good that you got married so soon and are wishing to file the petition for a now spouse overseas.

Not only that, you have to prove your income to substaniate you will not become a burden to the tax payers.

Do you have your 10 year green card? If so you are a Lawful permanent resident, you can file for you current wife but the wait will be long because you is not a citizen. You can put in a petition and once you become a citizen you can upgrade the petition. So you know it will be years before you can get your current wife here.

You have to show you meet at least 125% of the current poverty level. For a family of 2 that would be $19,388 for the year 2013.

You will need to show current income by paystubs and employment letter. Tax returns are also usually requested ot show a history of income.

Your wife cannot sponsor herself as she has no job in the US making the 125% poverty level. To sponsor using assets you would have to have 3X the 125% poverty level. Those assets would have to be US based.

You will have to provide proof with the filing of the I-130 that your first marriage, the one through which you gained your green card was bonefide:

You can establish by clear and convincing evidence that
the prior marriage through which you gained your
immigrant status was not entered into for the purpose

of evading any provision of the immigration laws;

Depending on the visa bulletin and how it moves you are looking at more than a year before she will receive a visa if approved.

Your current income matters. If you are employed right now and make 125% above the poverty guidelines, you should be fine. By the time they need your Affidavit of Support you will have the 2013 tax return that you can show together with your W2, paystubs and proof of employment. If necessary, you can write a letter of explanation why you did not file taxes from previous yrs.
