The Guides above will explain the process, the I 94W is now electronic, probably best to get your Husband involved as I know of no resources in French.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Welcome here!

Follow this guide: http://www.visajourney.com/content/i130guide2

No need for a lawyer, your case is pretty simple. It's a lot of work to assemble all the paperwork, but it's not that complicated. Just make sure that you read the PDF instructions for EACH form. They are all on the uscis.gov website.

Overstay is forgiven for spouses of US citizen, but better file sooner than later.

I-130 package is filed by your US spouse. I-485 is done by you. Most questions about forms are already answered many time on the VJ forums, so you can quickly do a search through the search bar on the top right of this page. You can find answers very quickly. :)

We know about the forms we have to fill out, but we dont know for certain parts what to check. But as a VWP which is not a visa we are not sure about how to fill them. do we need to get an immigrant attorney or it is not necessary. If so, do you know how much this is going to cost, ??

Thanks if you have some answers!

I-485, part 2, check a. You husband will prepare the I-130 petition and you guys will send everything in the same envelope. Make sure you separate everything with some paper clips, so it is nicely organized.
