Incorrect - there are many US embassies that don't process Direct Consular Filings (DCF). However, this does not mean that the US citizen cannot go and live with the foreign spouse or start the visa process in the countries which have these non-DCF embassies.

The USC simply would send off the I-130 to the Chicago lockbox like the rest of us.

Just to add to it, even if it is a DCF country, and the USC is not a resident of that country, they can (should) send the i-130 to Chicago lock box

True, if the husband is abroad but still resident in the US should send the petition to Chicago. My husband was deployed in Afghanistan while we filed for my visa and we sent everything there

- Civil wedding: September 10th, 2012

- I130 sent to the USCIS in Chicago on January 2013, while my husband was deployed

- Interview at the consulate in Naples, Italy in August 2013

- In the US since November 18th, 2013

- Green card in my mailbox on January 9th, 2014

I don't think she will be able to enter the USA on the tourist visa again now that she has married a USC either. However I disagree with the remainder of what you say.

The USC can now file the immigration based petition no matter where he is including outside the USA. He doesn't have to return to the USA. Its best if he has domicile in the USA or can show how he will do that upon return.

Once the immigrant has entered the USA on a CR 1` they can do the AOS with no problem.

I doubt it would take anywhere near 24 months to be approved for a CR 1 unless she is in a Mena country. Again we see a case where they don't realize its important to indicate the country so its hard to discuss the timeline.

Oh please if one comes in on CR 1 ...there's no reason to AOS that

would already be taken care of at NVC

We were planning on going back and start doing my paperwork since we rather be together through the entire process, before we came to my country we received our marriage certificate and after that we decided to travel. We didn't start any process. So now I don't know what to do..... I thought the best idea was entering the states with my tourist visa again? But don't know if in the system it'll appear as I'm already married since we did the marriage with my passport.

we all would have liked to be together during the process, that doesn;t mean you can. If you re-enter the US with that tourist visa with the intent to adjust status, that is visa fraud, plain and simple. The fact that you posted here, shows that you have intent(if that is what you decide). If denied it carries a lifetime ban from the US with no appeal, ever.

well maybe not bs it took hubby ad i 19 just to be approved now 4 months at nvc and we havent got a interview date yet . than if she from a middleeast country longer most are on ap for a few months . so we are looking at 2 yrs a long hard road,sorry but should have stayed home
