Hey... I went to the usa to visit friends on oct 2012 and came home january 2013, never overstayed everything was legal, then i went back to spend summer with friends, in jun and came home in septtember 2013 and when i went that last time i was told at Newark (first port of entry) that if i wanted to come back to the states id be better in applying for a visa to go next time.. why is this? my Visa waiver is valid until sep 2014 and i was planning to go again in May 2014 and come home within 2months or so...

They said i was entering too often? when ive only been twice!! xmas & summer and i wanna go again next summer (end of may) 2014

What do i do? go on the visa waiver? or apply for a Visa, what visa do i need? and if i need one, how do i prove my financial area that i can afford to look after myself while there? since i stay with friends and they feed me and stuff i just bring spending money... what do i do

im not sure if i posted this in the right area but if i did, im sorry!!

Unless you are of retirement age, B1/B2 visa will be denied so don't even bother with that.

I'd adjust your time spent in the US though - looks like you spent close to full 90 days on both occasions you've been to the US.

How long have you been in the US in the last 12 months?

Probably 2 80s lol within the last 12months

i wish theyd tell ya this before having to plan stuff..

Two 80 day stays is almost half a year, which is the max on a B2 tourist visa. So that can be seen by the POE officer as you stretching the limits of your VWP, which is why you were told to apply for B2. But if you wait until May of 2014, that will give you about 8 months out of the US, I think you should be ok for another entry on VWP in May of 2014.

Okay, how long do you think i dbe able to stay for, such as when should i have a return ticket booked? I was thinking of going on the 19th of may? So when after that? that would sound good so i could get in, i dont want them thinking im going to overstay or violate anything.. i have no need to

That would be solely up to the POE officer. He/she may give you 90 days, they may give you 2 weeks. Do what you think is reasonable time for what you are coming to the US for.
