I just received an rfe all for my joint sponsors info... And I'm confused!!

It says the joint sponsor must submit all supporting tax documentation... W2s 1099s etc... ( he submitted his 1040)

Next on the list it says joint sponsor indicated that a qualifying household members income will be used so he can meet 125% ( untrue nowhere on his i864 does it say this as he is well above the 125%) and he needs to submit another form from that apparent household member

Third of all it says that the joint sponsor does not meet the 125% ( untrue he is well above it....)

This makes no sense to me... What do I do?

1040 is not a complete tax return. The sponsor needs to include a complete tax return, which is different for each person, but includes W2s and schedules, and any 1099s.

Perhaps the joint sponsor ticked a wrong box. Is the joint sponsor married? Do they file joint married taxes?

Third is because the evidence was not satisfactory for the person to qualify. You need to fix the first thing (the tax return).

You have to send a complete copy of the tax return, which is all forms, schedules, W-2s and/or 1099s. You cannot send only the 1040 form by itself.

How did the joint sponsor fill out their I-864? Did they enter anyone in Part 6 #6 - 9? Did they check the box for #11? Did the current income they listed on #5 and #10 meet the requirement for their own household size plus the intending immigrant? Did they provide a letter from their employer, pay stubs or other documentation to prove that current income amount?

Ok I will figure out the tax teturn issue. He is married and they did file jointly. ( I DIDDNT think that made a difference? What do I have to do about it?)

No pays stubs or w2s as he is self employed. What evidence can he provide when self employed?

He did not enter anyone in part 6 and did not check 11

And as stated before the income is well above the requirement....

And as stated before the income is well above the requirement....

Self-employed can be a problem, because self-employed people are able to write off a lot of business expenses and pay less tax. This makes their income appear to be smaller. For self-employed people, they don't accept the gross, but the amount on their taxes (I forget what line it is atm).

If he is self-employed he should have a schedule C at the least in addition to his 1040.

If he files joint taxes, they may want the wife to submit a I-864A to allow that her family money be used to sponsor your husband. Does the wife work? Also, check what box he ticked on the form.

Good, so it's just a matter of getting a complete tax return.

He can order tax transcripts, which has all the required parts, if he doesn't know what the complete version looks like.

The wife does not work, so no need for her to do an I-864A. She has no income to combine with her husband's. Also, for self-employed, do not send a tax transcript. He needs to provide his complete tax return with every form, schedule, attachment and 1099 he would have needed to send to the IRS, as if he was filing by mail. That is why you got the RFE. You only supplied the 1040 and for self-employed, schedule c or similar is required. His current income listed should be the amount from line 22 of his 1040. Why not tax transcript for self-employed? It shows all the parts, the schedules, everything, doesn't it?

I suppose the IRS transcript could work ok, but since this is for an RFE and the I-864 instructions specify that the self-employed include all 1040 schedules, it seems safer to supply the complete copy with all the supporting tax info the RFE is asking for.
