K4 - is parental consent required?

I live in the UK and I've recently married a USC.

I'm applying for a K3/K4 VISA at the moment, and the father of my child, with whom I have shared parental responsibility for a long time, through mutual agreement not a court judgement, thinks he can prevent this because he will not provide consent.

Is his consent required for my daughters K4?

Yes consent is required. And K-3's aren't available anymore, for the most part. You should focus on the CR-1 path. Any and all paths require parental consent for a minor.

Wow, thank you for your quick reply. I thought this was the case. If he remains difficult, I suppose I'll have to go to the family courts and try for full custodianship, or somehow persuade him this is for the best!

The US does not allow a person to kidnap a child through immigration to the US. You should work now on an acceptable co parenting solution or prepare to move without your child if you decide to move

OP if your USC spouse has not filed an I-130 for the child, please make sure they do so. If the NVC closes the K3/K4 path to you, the child will not be able to move without an approved I-130 and proceeding on the IR2/CR2 path.
