I am currently a student and US citizen and have been with my boyfriend for about a year. I would like for him to visit me but I am not sure what I need to do. I have read in other places that I should go visit him...but I can not right now with school schedule, he is older than me, finished with school, and has the time to travel here and stay with me and visit.

We plan to marry in the future (when I am finished with school, I am graduating with a bachelors degree this year but I plan on attending graduate school) but right now we are just talking everyday through the computer/phone. Is there a way for him to be able to visit the US? Thank you.

He can apply for a visitor visa. You cannot sponsor him for one or do anything to help - that's just the way the process works for visitor visas.

All non-immigrant visa applicant must overcome the presumption of illegal immigration. They must show strong ties to indicate that they will return home after a brief visit. Strong ties include a job, property, social connections, family, etc.

Unfortunately, you are red flag to deny his application. As a US citizen, he could marry you on his visit and apply to adjust status. This possibility will not help him with the strongest ties because you are a strong tie for him to remain in the US.

All he can do is try. Be honest. Don't lie and hurt your chance for a fiance visa or spousal visa later.

He can apply for visitor visa but he needs to prove that he will be back such as job, property, etc. Because of you, National visa center might think he will not come back to VN. Also, Vietnam is red flag country which implies nearly impossible to get visitor visa for young people. You can try to apply but dont put too much hope on it.

Good luck.

When applying to visit the US, should he perhaps not mention me then? Can he just visit for a short amount of time, maybe during holiday season when I am not attending uni?

He had thought about applying for the fiancee visa, but it states we have to marry within a timeframe. What would happen if we do not marry. But afterwards (later on) decide to marry?

Thank for you the answers :)

As aaron2009 said above that be honest. It will affect your chance to get Fiance or spousal visa later if you guys consider to file it. I would think it is easy for you to visit him as you mentioned holiday which you have no school at that time.

If he comes to US under fiance visa, You and he need to marry within 90 days of his arrival. Othervise, he will get deported.

If he lies about you it will be trouble, so he should be honest. It's not a crime to want to visit a gf.

This is HCM Consulate we're talking about! One with the HIGHEST fraud marriage cases in the world!

I'm not saying the OP gonna do this but the trick is the OLDEST trick in the book. Coming here via a tourist visa, then get married with a USC. File AOS. Stay in the US without going back to the original country.

OP, nice thinking/planning. But be aware that the US Consulate is FULLY aware of this tactic. Do it wisely. You two can trip off the "alarm" bell overthere and will make your K1/CR1 case later on a very difficult one.

PS> Even when he gets lucky with an approved Tourist Visa and comes here and then marries you anyway, be extremely thoughful when it's time to do AOS for him. The USCIS will and still can deny his AOS if they smell marriage fraud in the air. Plenty of VNeses got denied in the past trying to play this game with the USCIS.

ETMM; Just visiting. We don't want to get married yet. We feel like whatever is said will be suspicious since it IS HCM. I guess for now my only option is to visit him until we're ready to change the relationship stt.

Which is why being honest about having a bf helps show they are not scammers. They are not trying to "play this game," so relax. They just want a visit.

I had my interview yesterday at USembassy applying for a B1B2 to visit my husband in the states. I was denied of my own personal B1B2 visa but grant me a B1B2 visa with annotation "TRAVEL WITH EMPLOYER ONLY". The consul said, since I have a petition going on, I rather wait for it to be approve and be reunited with my husband. I cant deny about my husband being in the states so I should really be honest to tell the truth. That was so frustrating but Im still looking forward to see him on Thanksgiving day when me and my lady travel to the states on that occasion.
