My son has a CR2 visa. His POE was 1 month after mine, so his green card expires 1 month after mine. Should I wait 1 month to file mine, so that I can file it with his as well? Or should I do 2 separate applications?

Would this be cutting it too close for my green card expiry if I file only 60 days before it expires?

If I do 2 separate ones, how do I prove his bona fide relationship as he is only 6 and has no accounts or proof of that type.

I'd wait a month - you'd still have 60 days or so of your green card validity - plenty of time to get NOA1.

For bonafides for him - your husband is listed as emergency contact in kindergarden/pre-school or doctor's office?

Good luck.

Ya, i'd suggest to file within the window where both of you 'are current'.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

File together in one application after your son gets 90 days of his GC expiration. It saves on application fee - just pay 590 plus 85 for your son's biometrics. Else you will have to pay 590 for each application.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Hi,

Attach link with the instructions for ROC: http://www.uscis.gov/files/form/i-751instr.pdf

This is other note:

Note on Filing Fee: Please include the base petition fee plus $85 biometric services fee for all conditional resident applicants. Each conditional resident child listed under Part 5 of this form who is a dependent seeking to remove their conditional status, is required to submit an additional biometric services fee of $85, regardless of age.

You MUST include your son in your application, and pay the biometric fee $85 for him. I recommend you make 2 checks, 1 for your form + biometric $590 and the other one $85.
For prove of bonafide for him, you can follow the Milimeo's advice.

You and your husband need to sign it the form.
