Dear All,

I am a Citizen and my wife is a valid GC holder. Also we have 2 kids, they are born citizen. End of 2009 for a family emergency (illness of my father in law) we all had to go Bangladesh without taking the travel permit of my wife. And then some other unavoidable reason we had to stay there almost 3 years ( December 09 to present)

Just recently I move back to USA without my wife and children because I have heard " she will have hard time/ will not be allow to reenter the USA. Is there anybody who can tell what could be the best solution for her? Should I start ALL OVER again I-130, I-864 with the help of a cosponsor or should she file with SB-1, DS-117, DS-230 for returning resident visa from Bangladesh ? If I do ether one, how long will take to approve her case? In advance appreciate for your time and effort.

N.B. Our tax files are up to date except 2012, which will file with in short period of time.

You can file i-130. She's been gone a long time, she already lost her LPR status. You will only waste time and money chasing a returning resident visa.

I think the returning resident after almost 4 years is a long shot, but it depends on what the unavoidable reasons are- rememebr, it has to be truly unavoidable, and not just expensive/ inconvenient.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
