Hi guys, I'm so happy and excited to hear about your status. I'm from Brazil and my partner from Utah, state that does not approve gay marriage. Do you think it will be a issue for us to get the K-1 visa? Have you guys hired an attorney or did by yourselves?

I have another doubt about this: Brazil approves gay marriage so I was thinking to get marriage here with him then he takes all the docs to prove our relationship and try to apply to CR1 visa. Do you think it is harder than K-1?

Si, the K-1 process is the same for everyone, so it does not matter that Utah only celebrates some marriages. All it means is that you will need to go to another state and get married there. For immigration purposes what really matters is that the federal government does. (The states as slowly catching up with the 21st century...) If you have never been convicted of any crimes chances are you will not need a lawyer. If you guys are internet savvy you should be able to fill out the paperwork you need, send it in and get your process approved in no time.

The CR route you mention is also a possibility, with the exception that the law in Brazil is very complicated for foreigners to get married. Other than that the process is the same as that for any other couple.

Hello, we decided to just research carefully and try it ourselves, and we don't have any complicating factors, so time will tell.

Just as Gegel mentioned, doesn't matter where you live for immigration purposes, just where you get married. We likely will be in AZ for at least a year, but will move if they shoot down marriage rights again next year.

We are still waiting. It is depressing to see people that filed in August are already receiving their NOA2s. I am beginning to wonder if the same sex petitions that were transferred to TSC are being looked over carefully and will take forever to be approved.

Who knows to be honest.... I have only heard of one case being approved for same sex couples...

No need to di it with a lawyer. You can all do it by yourself. Just read the K! Guidelines here carefully.

And guess what it doesn't matter if UTAH has gay marriage. You can get married in any gay marriage state within 90 days after entering the US with you K1 Visa. My partner is from Florida. Florida has no gay marriage either....

Yay!!!!! I am excited.... I guess they are taking a little longer at TSC in issuing this notification for people who filed in August... I have seen lots of VJers that get that message a day or two after USCIS receives their application.....
