After having spent hours on immigration websites, calling embassy, etc, I'm very grateful to have found this website. I'm currently living in Europe with my fiance and we are planning on getting married to have him come to the US. I do not want to go back and apply for the Fiance visa as I know this is a very lengthy process. We are actually planning on going back to the US next month, getting married, then coming back to Europe. Does anyone know from experience which visa they recommend us going for, that would be the fastest? I know there is the CR1, but from what I've been reading this can take at least 6 months. Is there any sort of faster process we can take seeing as we are both abroad? Thank you.

yip .. get married .. file dcf or from abroad, whichever you can do.. both will be faster than doing it regular from the states

No DCF in Spain. Sometimes couples filing from abroad get their cases approved a little faster, but no guarantee. That's all there is.

6 months isn't so realistic though. Try 8-10.

yikes, 8-10?? Does anyone have any sort of experience with them coming to the US and staying? I know it's technically illegal because of the whole "intent to stay", but I've also heard of many people doing it. Just not sure if it's worth the risk...

OK last questons I promise :) While this visa is in process, is my foreign spouse allowed to come to the US to visit? I've heard that it's not recommended because they could get denied at the border thinking he might stay. However, as we all know, having applied for a CR1 visa is obvious intent to stay which would lead to a lifetime ban, so why on earth, while paying all the fees and applying the legal way, would customs think he actually wants to stay? Wouldn't the visa actually be proof that he's planning on returning since it's being done the legal way? Also, would a letter from an employer be enough?

Is Spain a VWP country? I forget!! If it is then he should have no problems coming to visit. He should bring proof of ties to his home country, such as leases, a letter from an employer, proof of school enrollment, bills etc... Things that show he has a life in Spain and isn't trying to immigrate at this time. I always took a photocopy of NOA1 as well to show I was doing things in a legal manner. He can present this if asked to help lessen the likelihood of being denied entry, but at the same time, he can still be denied entry as it's up to the individual CBP officer. It's important to tell the truth (I'm visiting my wife/husband/fiancée etc...) and it's really good to have a return ticket or itinerary handy, be polite, and have the proof of ties. He may never be asked to show them but better over prepared than under! :D Short stays (a few weeks at most) look better than long ones.

Someone on the VWP can stay up to 90 days (it's best to leave BEFORE the 90 days are up) and can visit for a total of 180 days per 364 days.

trust me, I know how you feel since you do not want to be apart from your love BUT you have to be realistic if you are going to do this process and be prepared to wait. As mentioned by someone in a comment before, a CR1 is realistic about 8-10 months. Mine was a total of 9 months and I feel grateful because other people have had longer wait times. You definitely want to do this process the legit way because if they suspect any fraud (intent to stay) then you take the change of denial and ban. This is hard on everyone who does it BUT in the end it is worth it!! <3
