I-94W section of an I-485 on VWP... please help!!

Hello! My situation is that I am in the US on a VWP and met the love of my life, we are getting married in 4 weeks and we have the forms I-485 for permanent residence and adjusting status and also the I-130 to petition for an alien relative. I don't have an I-94 and on the form there is no VWP option, I am worried to fill it in wrong and have it rejected since it asks for my I-94 number. In fact, there's lots of visa related info requested that I wouldn't have. The last thing I would ever want is to leave my husband here and have to go back to the UK or worse not be allowed back. Also, here are the forms I am pretty sure I need:

  • I-485
  • I-130
  • I-864
  • I-693
  • G-325A (for us both)

On the VWP, since I was not given back my I-94, do I still use the same forms as everyone else?

You do not have an I-94 since you entered on the VWP. Enter "None - VWP" where it asks for the I-94 number.

We had the same issue as my fiance's country is also visa free. Check this website and enter all the information correctly. The i-94 number will be returned:

Some confusion here. All K-1 people get I-94's, no matter what country they come from. So your fiance's experience was in no way different because of her country in that regard.

The OP did not enter on a K-1 visa, or any visa at all. The OP actually entered on the VWP and will not be issued a I-94. The OP will not find anything on that site.

So you did not have the same issue at all.

Hello, I am in the exact same position right now as you were (I came here on a VWP, from England, decided to stay here and marry my BF, I don't have an i-94 number as they took the form away from me after I came through customs!) and the retrieval website doesn't work (I assume because I came here on a VWP) and I wanted to know what you filled in on the i-485 form. Did you put "None - VWP" like someone on here suggested? I'm really anxious.

I also came here on the VWP and applied to adjust status. I too was confused at the time and put only VWP on the forms and got a RFI asking for my 1-94 and was told i could retrieve it from the website which i did. It worked fine for me I just entered my info and it came up and i just printed it off.

VWP does not get I-94s. Sand_dancer, did you enter on the VWP many years ago?

To the OP: You can show your passport stamp. That is proof of legal entry.

VWP does not get I-94s. Sand_dancer, did you enter on the VWP many years ago?

To the OP: You can show your passport stamp. That is proof of legal entry.

No i entered last time on may 29 this year. When I asked in this forum what to do i was advised to retrieve it on the website. Also thats what USCIS told me to do and it worked fine for me and they accepted it. :s
