my grandfather is petitioning my mother the petition papers was filled way back at 2004 of may 25th as of now we are waiting for the Immigration visa payment status to change to "Paid" (we already paid for it of course) and now the question arise for us can i a 24 year old unmarried son of my mother and my sister who is turning 21 this september unmarried but have a 1 month old child accompany our mother ?

other information i can provide is that were using our father's surname but our mom and dad aren't married

if yes what do we need to do?whom to we need to inform that were going with our mother?

You are too old to come , cpsa applied to the petitioned person. Your sisters child is NOT included no matter what age your sister is.

CSPA applies to derivative beneficiaries as well.

How do you know he is too old? How do you know this without knowing how long it took to approve the I-130. You don't, so there is no way for you to say that he is too old.

The only thing you got right is that the sister's daughter cannot get a visa.

Why you you keep making stuff up that discourage people from immigrating? You are really screwing with people's lives in a bad way.

If the mothers birth certificate for the children show a marriage date and that date was before the grandfather became a USC then they can't come If they are using the father name that probably happened.

The parents did not get married so this is a non-issue.

ivanvash02 you have to find out exactly when the petition was approved. It is needed in computing your eligibility for CSPA.

anyway even if they are starting to request the paperwork, your mom still has to wait until the priority date becomes current, I'm surprised that they are requesting it now

if you check the visa bulletin for August for the Philippines, it is January 1st, 2001, unless you gave us an incorrect priority date.

when was the petition filed, not when it was approved?

if it was filed in 2004, then she still has several more years of waiting

check the category F1 for Philippines

plus, as said your niece is not included in the petition, so your sister should know that.

im also looking for that date when it was approved we have no email about that probably my grandfather have it in hawaii we have no idea

Even if your mom is F2B - Phils. she still has 1-1/2 years to go to be current. You can email or call NVC (NVCInquiry@state.gov) about it but you need to provide the case # (MNL???); or if you have the USCIS receipt # (SRC???) you can check in the USCIS site (http://www.uscis.gov/portal/site/uscis).

so i tried a cspa calculator it said im only 15 years old and im still applicable for immigrant visa now what should i do? and by the way guys my mother is about to fill up a DS-230 FORM so what step should i take about this CSPA thing and my sister whos about to turn 21?
