So I am Brazilian my husband is American we are married for over 4 years and have a 5 year old daughter... She is american born. I was in the US with my mom when i was a teenager, she was trying to make a life there with an overstayed visa and it didnt work out and we all came back to Brazil me with my daughter and my husband i was 17 years old.

My husband went back to the US on February of 2013 and the package he sent to an office in Arizona was received on february 28th(almost 5 months ago). After that email that they received our package we got no other e-mails i keep thinking its good cuz if they needed other information theyd contact us but im still worried, and my daughter and i miss my husband to death sometimes i wish i have never accepted to move back to the US... Anyways is this normal? What am i waiting for? an email? a letter? if i get approved with the i-130 what is the next step? and how long after i am approved they will schedule my interview here in Brazil at the American Consulate??

I overstayed a visa just like my mom i think it was a A-3 type of visa asked lawyers and they said that it doesnt matter if i was married if i was under 18 when i left the US i have no time bar on me and i was i was 17 and 9 months

My husband send the i-130 and i-485 all in one package to and office in Arizona.

Study my timeline.... hmm.. the USCIS website says my process will be done in 6.3 months i dont even know what the .3 means 3 days? 3 weeks?

And it doesnt seem like I can make my own timeline since it all depends on the US governament....

What is na OP?

What do you mean with 2 offices? There are two main packages of documents involved, one is sent to USCIS, one to NVC at a later stage.

Why did he send both? On I-485 instruction it says "this form is used by a person who is in the US to apply to adjust to permanent resident status or register for permanent residence" - but are you? And it looks like the person does it for him/herself?

oops - he sent the I-485 ? You might want to engage with yer spouse to call into USCIS, get a Tier 2 Human, and let the Tier 2 human know that the I-485 was sent by mistake, as you're not in the country.

I dont think i have a document sent to the NVC and its been almost 5 months was i supposed to all the info i got never said i should have...

Documents are sent to NVC after the petition is approved, so you'd know when you have to send them, i think.

I'm a March filer, so almost 5 months here too. It seems 6-8 months is average time before I-130 petition approval.

Unfortunately, i don't know if there are any consequences of sending extra forms.

I think you should explain where it is in the profile. :) Because it appears that IR-1 Journey is thinking of something in USCIS website.

in I-130 processing, since 15 AUG 2012, casefile routing goes like this:

lockbox->MSC->local uscis office

it's normal. Pay no attention to it until it's past the 6 month duration, or 6 months past NOA-1 date.

Ahh, ok. smile.png USCIS is NBC for our purposes now. NVC is next authority. I suggest you read the guide because it's really quite enlightening: http://www.visajourney.com/content/i130guide1 smile.png

Whole chain is:

(1) lockbox->MSC (called NBC now)->local uscis office ------)> (2) NVC -----)> (3) US embassy in the other country
