Hi.

I was convicted of drug trafficking in 2002 at the age of 22 after being a legal resident in the U.S for 16 yrs. I had a public defender represent me and got me a plea for 24 months after testifying under oath, but being deported was never mention by my attorney. After completing my sentence I was taken to INS and sign a voluntary departure to leave the country.

Now after being out of the U.S for 9 years I would like to Know if there is a way of getting back in to the country the legal way?

Note: I’m married to a US citizen and have 3 kids who are also U.S citizens.

My mother lives in the U.S with my step father and Im their only child. Can any one Help?

You are going to have a very uphill battle. Drug trafficking is considered to be a crime involving moral turpitude.

You would need to file an I-212 (permission to re-enter after deportation / removal) and an I-601 (to try and overcome your inadmissibility resulting from your criminal conviction).

It's not a DIY job, and you should consult with an experienced attorney. Given the facts, it's not likely that you will be successful, but it's up to you whether you want to try or not. It will be expensive.

A very experienced (read expensive) attorney might be able to help you. There was some flack about LPRs beings talked into pleading to crimes without being informed about the affect it would have on their legal resident status. I have not kept up with it but it might be worth it for you to do a little research. If you can find an honest attorney (read one who doesn't bs you just to get your money) you might have a slim chance.

Honestly I really doubt it, and you can't re-enter the US with this charge.
