To immigrate as the spouse of a US citizen, there are several hoops that you must jump through.

First, your wife wants to file the I-130 to get things rolling.

Second, she files her US tax returns for years 2010, 2011, and 2012. It's easy because there is a $90,000 (approximate) foreign income exclusion so your wife will owe zero in US taxes.

Third, she completes the I-864 Affidavit of Support with a copy of her 2012 US tax return.

Fourth, you apply and interview for your visa.

This takes 6-12 months for this process to happen on average. Your January 2014 deadline is cutting it pretty close.

Your employer may be in the best postition to help you. Perhaps, your start date could be delayed.

It shouldn't take this long as they can apply for DCF via the London Embassy.

I"m just wondering if this post should be moved to the DCF forum or if the OP will be pursing a work visa.

Have your wife file DCF (doesn't matter she's not working)in London Embassy,

then have her get a co-sponsor in the USA...So tell her file now, she has to

have an address in US (what's up with her parents?)she can also file back tax

whether or not she works she's suppose to file even if she lives on the moon

How did the employer offer you a job without checking your immigration status? The first thing any prospective employer asks is if you are able to legally work in the US. I am assuming they knew you are British, therefore they should be prepared to wait. Does your company have an office in the UK? Maybe they can hire you in the UK and then do an L1 visa which is a work transfer

So many questions...

Best bet would be for the USC to go back first and get a teaching job which would easily provide the income needed and prove domicile.

After filing the DCF through London.

Hi everyone,

I'm very new to this and have a question regarding sponsorship.

I am a UK citizen and I have been married to my wife (US citizen) for nearly 4 years and we've lived in the UK for the whole time (she's had UK spouse visas).

We are now planning on moving to the US in January because I have a job offer but it seems to me that I need my wife to sponsor me getting a green card. The problem with this is that she's been living in the UK for nearly 4 years and so there's no way she can sponsor me.

Is our only option to get somebody currently in the US (a friend/relative) to sponsor me so that I can apply for my green card?

Hope that makes sense.

Get your employer to file an H1B for you. Its a lot easier and quicker coming from a corporate and their lawyer will deal with the system. It will take a few months for you to get a GC through DCF. I doubt your company will wait that long.

DirtyHarry, I think I have less knowledge on immigration issues than you, but on this one you are absolutely wrong.

First of all, he has an intention of migrating to U.S. This is obvious. At any time applying for a non-immigrant visa like H-1B or L-1 as you mentioned is an automatic rejection when USCIS finds out that he intends to migrate to U.S. Plus, it would make his chances to get an immigrant visa lesser. I got this info directly from the Istanbul Consulate.

Michael good luck with your case. Mine is a little similar, trying to get a Green Card for my wife but I choose to be with her during this period in Turkey (I'm a dual citizen).

Since I made way less than the amount required I will need a sponsor as well. I might use a friend or my last employer in U.S. Your wife may use a family member or one of her friends as well since the purpose of this procedure is for you not to go on Welfare. And you are saying that you have a business offer, this is a good thing, make sure to take that with you at the interview as it may qualify as a document that shows the intention of living in U.S.

You are wrong.

Both those specifically allow dual intent.

Correction, Boiler is right. I got this info when I was going to get a tourist visa for my wife. So, H-1B & L-1 might be good. But not a tourist visa Michael.
