Timeline

Do I need to send in a certified copy of my marriage license or can I send in just a photocopy of the certified marriage license? It's $20 per certified copy, so it would be nice to avoid that cost.

Please let me know what you did and if it worked. I read some places it needs to be the original certified copy and other places say a photocopy is fine. I just wouldn't want to get an RFE, but I also want to avoid an unnecessary cost.

We included a certified copy for each package -- AOS, EAD, and AP. Although, certified copies were much cheaper for us! We spent about $20 for four copies.

I sent a certified copy for AOS, and photocopies of it for EAD and AP. The IO gave me back my certified copy during my interview. I'm glad he did... that was not cheap either.

If you send in a photocopy, it should be fine. I made the mistake of sending in a certifide marriage transcript. That was a costly error as I ended up getting an RFE. They wanted a copy of the marriage certificate. I sent them a photocopy of my marriage certificate back and was issued my GC 2 weeks later.

I put these 2 documents side by side and the only difference between the 2 was the wording.

AOS and AP will be approved in 2-3 months. The AOS timeline is highly variable. If you are scheduled for an interview, it may take 2-3 months. If you are waived from an interview, it takes a lot longer, up to more than a year. What is your local USCIS office? It may help to get an idea based on the timelines data on VJ... some offices almost always schedule interviews for AOS from K-1. Some almost never (too busy). Some others, it's 50/50. :)

* A marriage license is a permit to get married.

A marriage certificate is an actual proof that you got married.

You have to send a marriage certificate, not licence, in order to AOS based on marriage to a US citizen. That's what Harpa was pointing out.

* You will not send your paperwork to your local USCIS office, but to the Chicago lockbox (read the instructions for the detailed address). Your case will then be transferred to your local office if you are scheduled for an interview, or stay at the National Benefit Center if you are waived from an interview, and be adjudicated there.

It seems that not many people are scheduled for an interview there... so I would expect a long wait.

I used a certified copy without a problem. My county had a deal if you ordered more than one, you could get a discount. So I ordered three -- figured it'd be useful to have one in a safety deposit box, another for the naturalization or whatnot.

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
