Here is my situation.

Apply for K1 visa - July 2009

Married in U.S. - March 2010

Divorced - March 2011 (ex-wife got the 2 year conditional greencard but not permanent one)

Applied for CR1 visa - April 2012 (after marrying the 2nd wife)

Petition Approved - Oct. 2012

Interview scheduled - Jan. 2013 (but then she decided not to come to U.S. and did not want to stay with me)

Withdrew petition - Feb. 2013

Here are my questions:

1. At this time, am I eligible to file for another K1 visa petition?

2. How difficult will it be to get this petition approved?

Thanks.

From just looking at the immigration issues, you shouldn't have a major problem. After 2 K-1 visas lifetime you would need a waiver, or 1 approved K-1 in the last 2 years you would need a waiver. You don't seem to meet either threshold that would require a visa waiver.

It looks like any future K-1 visa applied for would be a straightforward process, just like a first time through.

That said, 2 marriages of under 1 year, one which might still be in effect, might raise eyebrows at some point in the process, but more likely at the embassy than at the USCIS service center. If you are still currently married you are, of course, ineligible.

I wonder what the record is?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

If ever USCIS were to be suspicious, I would think a third marriage in three years would probably set off alarms. Even if it doesn't require a waiver.
