Just got a text from them, saying they are sending a RFE. I'm not sure why, since I gave them ALL forms, and required info, and in great detail. I hit the 60 day transfer notice like 2 days ago... Coincidence? I think not. Looks like they are playing games to buy more time, and make it even more difficult for us. My wife left at the end of June, and we are both very frustrated and angry. We had our I-130 put in at the beginning of May. It's Friday night, now I have to wait till Monday before I can call anyone about this... To top it off, I'm away for 2 months for a road job... #######... This is totally not cool at all. My wife is flipping out. And I am equally angry.

Anyone know about how long it takes them to get the notice to you, or if you can even call them to see what the RFE is about? I kinda want to get a head start on this in case we have to play games mailing stuff back in forth between my wife, and myself to send them their "request". Or even how long it takes them to approve after they get their evidence? I'm really angry about this right now. Is there anyone else that had similar thing happen?

I've seen at least one person who got a tier 2 (I think) to tell them what the RFE was for. Mostly they don't, though and you have to wait for hard copy. Sorry this is happening to you.

On feb.4 my husband was filled the expedite for me due my permit of stay here in Italy will be expired on May, but we didn't heard anything about that. No rfe either...

Folks, we sent our I-130 package last may, to do the embassy process, via Rio in Brazil, but I came to US last month (using my tourist visa) and now we decided to stay here and do the adjustment of status. Somebody know how to proceed with USCIS? I'm expecting NOA2 in the next week or so, since it will be 60 days since the process was transferred to Nebraska on Feb. 18th. So, when I get the approval, what should I do, since my stuff do not need to go the NVC anymore? Do I need to contact USCIS and let them know that I am here now?

PS: we didin't hire any lower for the I-130.

You should really discuss this with an immigration lawyer. Our lawyer strongly advised against this route (readjustment of status once in the US on tourist visa) because even with the readjustment of status the USCIS will inquire with your local consulate whether they have a file on you. And your local consulate may issue a negative advice since you decided to stay in the US on a tourist visa.

I agree that it would be wise to talk to a lawyer at this stage, although there may be people on here who've done the same thing and know how to do it.

You'll need to file an adjustment of status - I know that people generally do this concurrently with their I-130 if they're taking this path from the outset. I don't know what you need to do to convert your file from consular to Adjustment of status.

There is a forum about it - maybe search on VJ for AOS from other visa types or something like that. The people on those forums will have better advice for you. (PS you might get some grief from the people on this forum for trying to circumvent the "rules" this way)

hi guys my i 130 got approved last week the problem i need to move temporarily for 3 to 4 month with a friend until my wife comes here now should i renew my address with uscis and give them a p.o box to receive the letters from them or should i mention to them that i am living with a friend temporarily did anyone had a similar situation
