NVC Filers - April 2013

Hi everyone,

For my spouse, her I-130, NVC etc. all got approved and case completed and her interview date is in a few days - in the second week of May 2013.

I just realized as we were preparing for her interview that our lawyer incorrectly put her parent's country of birth as India instead of Iran in the G-325 A Biographic Information for my wife (the beneficiary) - I am so surprised that the lawyer, myself and my wife all missed this and there was no RFE etc. Now I am freaking out as to what I should we do?

I read somewhere that she needs to just get a corrected G-325A printed out and hand it over to consulate?

Should she do that or just take a chance and see if they ask that or not? Since my wife is from Iran and is going for interview in New Delhi (where she lives for the past several years), it's possible that she has to go for AP so I just want to make sure we are doing the right thing here.

She has a copy of her parent's passport copy that she can also take just as proof.

There's no harm in including that, but honestly, to me, it'd be pointless (as a reviewing officer). If it were me, I'd leave it out. And if you do get a job by the interview, fill up a new I-864 with that information, as well as have pay stub(s) ready to bring as well.

It sounds like you're more of just VISITING Canada than actually living there. Which, if you are, then you really don't need to worry about proving US domicile.

I think the most confusing part about this whole process, is that from the beginning, I've seen (2) different things.

I've seen "proof of establishing domicile" and "proof of domicile"

Everything I've ever read made it seem like this is something EVERYONE must do.

It wasn't until yesterday that I saw something in your wiki (I think) that made me think it's not necessary for everyone.

So, to set my thought straight.

If you didn't file from "abroad" you don't have to show proof of domicile?

Correct. If you do not file from abroad, you do not need to show proof of domicile.

blarg two months? every time I think we're close it gets pushed out again. whine whine complain curse whine.

It can always be sooner. If someone cancels or some other reason there's a sudden opening, your case can be scheduled for that slot. But, like I said, the average does tend to be around 2 months. Which should give you plenty of time to get the medical done and gather all interview documents.

Just bring an updated G-325A to the interview. You wouldn't have gotten a RFE for that as background checks aren't done on parents or relatives, just the petitioner and beneficiary, so of course that mistake wouldn't have been caught by USCIS or NVC.

If you're unemployed, you're unemployed. You can't write N/A as that question is definitely applicable. Don't ever leave things blank or you'll get a checklist as they'll assume you didn't fill it out. So write unemployed.

Nope, not everyone provides proof of domicile. This is only for petitioner LIVING abroad. That's when they have to show proof they're in the process of re-establishing themselves in the US. So, in your case, since you're just visiting Canada, you're not technically living there, thus no need to provide proof of US domicile.

They definitely do background checks at USCIS. And I'm not 100% sure, but I'm guessing NVC does some kind of checks.

I think that's why I just waited to get the emails that said they got the items. Took about 4 days for each. I

Hello We got approved since march of 25th, we havent been given case # either. I looked at some VJ members and statistics say we have to count 1 month and 5-10 days, so lets fingers crossed

well they took 8 days to generate a case number for my case...but i still havent been able to do anything with the case number as yet, since i cant make a online payment neither have i recieved a email in regards to my ds-3032, i hope you'll get your case number soon but keep in mind you still have a little more waiting after that....good luck.

Sent IV pack on 31st - received acceptance on Apr 9th.

Sent AOS on the 4th, acceptance on the Apr 11th.

Is that normal?

I thought it was usually the other way around.
