Hey how is it going Guys? Well I currently live in Mexico, and married a Mexican citizen, we married 06/06/2012 and I now wnat to go to

the U.S. and take my family with my, now my wife has a daughter from a previous marrige and I have a lot of questions to ask.

1. I know I have to file the I-130 for my wife and a seperate one for my step daughter, do I file them at the same time?

2. I currently live in Mexico and I came across the info that I can send the form to a Embassy in Mexico instead of sending it to the Chicago Lock Box

is this process faster? Or is it the same?

3. My wife had a b2 visa previously, she had overstayed the visa and was caught and was brought back to mexico she has a 10 year ban of which she has

2 years left, I know I have to file a I-601 but how long does that process take?

4. My wife's family have visa's my father in law was in the U.S. when he had a heart attack, he is currently being hospitalized, I was wondering if there was a way to get a k3 visa faster for this case of emergency, I was also wondering how long does it take to get the k3 visa once the application has been accepted.

Thank you for reading this, I know there is a lot of questions and I do really appreciate anyone who is willing to help me.

Yes I believe you will have to apply for both petitions at the same tie and an mail them out together. Even if you are outside the U.S. you will still need to send it out to Chicago Lockbox. Herein the link where you can read directions and application. Directions may answer some of your questions. Not sure about the I-601 or visa K3. Best wishes!

K3's aren't processed anymore. Not worth the effort as they cost more overall and they take the same amount of time when they do slip thought. Your wife will either have to finish out her ban or you will have to file the waiver paperwork. For this you should either hire a lawyer or seek help on immigrat2us.net ,it is much more than filling out the forms and by living there you have in a way made it harder to prove hardship. Unless your father in law is going to die imminantly there is little hope of shortening the bar bacause of a parents health. What was the daughters age when you married ?

Thanks a lot for responding, well my step daughters age was 4. I have been living in Mexico less than 2 years, but I still have gone to the States a couple of times visiting my parents and also staying to work for a few months. My father in law is still hospitalized but I do not think it is a imminent death but his health is ill. What is the quickest way to get my wife to the States?

Mexico has some special rules that I don't have memorized. I am sure someomne will give better answers. As for as the I130 , filing in country is faster when available. Your issue is the hardship waiver(s) was your wife offically deported or did she leave on her own. Your stepdaughter needs her own I130 package

She was caught and deported and was given a 10 year ban. I've looked over a lot of info and it gets confusing, the thing that I want is to get her in the states as soon as possible now I know that I have to fill out the I130 for both my wife and step daughter, now I don't know what form I have to fill out I thought it was the k3 but I will have to read more info tomorrow. Thanks a lot for the help I really do appreciate it.

So if she was officially deported you need 2 waivers, the 601 and the 212. Your problem is part of being successfull is showing hardship to you and one of the most common things is proving you can't move the the other parties country. You are already living there so that is out. Go to immigrate2us.net they are the waiver experts.

If you want both to immigrate at the same time, then you file both petitions at the same time.

The poster who told you that you had to send your paperwork to the lockbox in Chicago was not correct. Since USCIS has field offices in Mexico, you can submit your paperwork to the field office of jurisdiction over where you currently reside in Mexico.

I'm not qualified to answer this.

Current USCIS and NVC procedures have rendered the K3 virtually unobtainable as it is usually administratively closed by the NVC (the statement "K3's aren't processed anymore" by a another poster is an incorrect statement because the K3 officially remains on the books and would be processed to the dead end point of administrative closure).

Oh yes the DCF by far is way quicker. You could be done very fast. So get on that.
