Need some info: ME and my fiance applied a K1 visa last oct we are expecting my interview to be sched on april.. my concern was is there any possibility to move or adjust the expecting month of interview for another 3-4mos? does K1 application has expiration? coz we found out that my first marriege was still registerd, my lawyer said we need 3-4mos time before its legally null and void but i have K1 on process now and we expecting to be called for the interview this coming april or May. can we do something abt this to move or adjust?

Anybody there knows abt this matter?, any information will highly apreciated.

I'm probably not entirely qualified to answer this but I found myself in a similar situation. I found out my girlfriend was still officially married after I had submitted the I-129F. I cancelled my petition, helped her get divorced and now I'm refiling this week.

I think you need to cancel your petition, get divorced and re-submit after you've gotten divorce. If you're still married, then there's incorrect or erroneous information on your G-325.

If you want to eventually gain a visa I think refiling is the prudent course.

But, I'm an newbie here...there might be different opinions.

Your lawyer should know that you needed to be free to marry at the time you file the I-129F petition. You were not. You cannot simply delay your interview. Your petition will not be approved since you do not meet the requirements. Even if the petition slips through, you cannot be approved for the visa because you were not free to marry at the time you filed. You need to withdraw the petition, get divorced, and file again when free to do so.

Well, besides the fact you need to be free to marry when you file, there's almost no way you would be interviewing in april being a CSC filer :rofl:

Your lawyer should know that you needed to be free to marry at the time you file the I-129F petition. You were not. You cannot simply delay your interview. Your petition will not be approved since you do not meet the requirements. Even if the petition slips through, you cannot be approved for the visa because you were not free to marry at the time you filed. You need to withdraw the petition, get divorced, and file again when free to do so.

Your application will be denied. You MUST be divorced and "free to marry" before you file the I-129f. The petition you filed is not valid and you are currently not qualified to file an I-129f. Withdraw the petition, get the divorce finalized, then file a new petition.

Your timeline is vague. I presume you filed a PETITION (I-129F) in October and have not yet received the approval of that petition. If that is the case, the petition will NOT be approved, it will be denied.

If it has already been approved (I doubt it) then your VISA will be denied as you must present your marriage and divorce certificates from your previous marriage at the visa interview and the divorce must have been FINAL when the petition was filed. If someone made a mistake and approved your petition, it will be discovered at the next step

Not to add stress on you but 3-4 mons for annulment is nearly impossible. It will take at least 12 mons up to 2 years for the entire process. Also depending on the grounds for annulment and if the legal husband will contest or not.

No, you can always delay the interview by simply emailing the Bmbassy and requesting it.
