hello...so i welcome everyone to my topic, i will share my story and write about it as shorty as i can. i would appreciate any help so much, i am kinda desperate and i would love some answers or suggestions..here it goes.. so basically me and my boyfriend met on the internet years ago. we talked on and off, but we had like a two-three year break and in the mean time i lived in america 2 years as an exchange student and graduated hs. i went back to my country and started talkin to him online again, we didnt know each other in real life yet then. we started dating online in december 2011 and he came to my country for a 3 week visit in may 2012, then we came back again for 2 months, with the intent of staying in my country for good but he had to go back to america cuz he couldnt get a job in my country. we decided that we will try to settle in america as life here is just easier, i didnt wanna be apart from him for long. we wanted to apply for the k1 visa but he didnt have a job then and we didnt feel like waiting MONTHS, so i applied for the tourist visa and here i am now, my second week in the US, i can legally stay here for 6 months. the thing is, when i filled the form for this tourist visa i said that i am going to stay with my host family (from 2 years ago when i was an exchange student)in another state, so they have that down, when in reality im with my boyfriend, if i was truthful and said i was gonna see him, im sure i would of been denied that visa. so yes it wasnt the honest truth, but then again, its not like im here illegally...anyway...we wanted to get married for a while now and we prob will soon, but id love to stay here...i know that i could go back home and apply for the k1 or a spouse visa, but i dont wanna be apart from him for months again...so i was thinkin about gettin married and applyin for the AOS...i know that they can question me since im on a tourist visa, but they already 'think' that im stayin in another state with my host family, so i thought i could just say that i have met my husband to be while i was visitin with my host family. what do yall think? can this be risky? i know its all expensive, i know its better to get married after a while and not immediately after my arrival, if i had succeded getting the tourist visa, maybe this could work too...i know that its legal to get married and adjust the status, as long as that wasnt planned from the start, i cant say that we planned this, we wanted to get married and for me to stay here for good, but we were mostly thinkin about the k1 visa, but i dont feel like going back to my home country...

that is why i want to get married later on, not just yet...for it not to seem weird.

no sympathy? really? what have i done to you...the law itself is ridiculous and denies all kinds of things to those that are honest and good. do u have sympathy for the consuls at the embassy denying people visas? people that have evidence of being attached to their country with an honest intention of visiting America while those that bring no proof get 10 year visas? like i said, the law itself is crazy and some people out there are too.

You're new to this so I'll go about this as diplomatically as possible: Do not ever lie to immigration and customs. It will most likely come back to haunt you and result in a lifetime ban from the United States. No one on this forum is ever going to advise you how to evade immigration laws, which is what it seems you are trying to do right now. Since you're in the US you can get married and he can file for a CR-1 spouse visa but you will need to go back to your home country and wait it out until your embassy interview. If you try to stay and adjust status chances are you will be investigated by USCIS heavily and they'll find out you lied to gain entry on the tourist visa. We all have to wait a long time apart so don't go thinking you're the only one. I see my fiance 4 weeks a year and it sucks but I manage because I have to. If your relationship is meant to last then you will manage too.

Besides a K-1 is for beneficiaries who are outside the US only. I recommend CR-1. Your fiance will need to get a job or a co-sponsor though or you'll be refused for lack of a financial sponsor.

Again: DO NOT LIE TO ANY US GOVERNMENT AGENCIES. EVER.

okay i understand. alot of people do that though and get approved...there are many succesful stories, if these 'agencies' question the solid truth sometimes, then idk what to even say, because they do deny people with lots of proof and people that are completely honest..

If you have such a strong entitlement feeling to living in the US, then you're in the wrong place. If you're just here to complain about how "unfair" it is, I'm not sure what type of information you're going to get.

It's against this forum's rules to tell you that it's okay to do what you're describing.

If you're so sure that it's going to work, just do it!

ok i understand, well i apologize then. saw a lot of stories like this and thought it was okay to make topic like this and collect some suggestions, i have been suggested to do it legally and i understand that

This is quite the attack. Look, given the new laws you arent going to adjust, you will be sent back home and have to go through the process anyway. Our laws are in place to allow our country to do its best to keep fraudulent people out. Whether you think its crazy or not. For someone like myself who had to fight through 2 years in this system to get my husband home, it literally chaps my behind to hear someone wanting to come along and do things illegally. Do you think it was easy for US?? Nope! But we did it the way my country demands it be done, legally! And we went through a high fraud consulate! I hope you understand that you have put this on a website that immigration can and does check!

what am i supposed to do then? i dont wanna get in any trouble

Or are you just trying to get a few folk to bite here? Theres some brilliant people available on visa journey to help folk with genuine visa issues..........if you're for real but just VERY ignorant to how the process works then my apologies.

right now im just trying to not get in trouble...i didnt realize the government checked this website

I understand you want an easier, quicker way through this process, but it simply doesn't work that way. As for others being denied despite all the proof in the world, you are only getting their side of the story. There can be things in their past that can cause them to be denied, without immigration disclosing the information.

Seriously, just do it the way America says to. Why fight a government and lose?

You would have been OK except for this. Even intent upon entry is overlooked - with no other serious negative factors - but if they find out about misrepresentation, it will most likely be denied. I'm sorry, your best option is to either get engaged and have your fiance file the I-130 while you are here, and go back to your country without overstaying your authorized stay; or get married and have your husband file the I-130 while you are here, and go back to your country without overstaying your authorized stay. While they may not find out about the misrepresentation, not long ago there was a member whose misrepresentation was found out when he was applying for citizenship. At that point, not only is citizenship not granted, but the green card can be revoked and removal proceedings started.

The only thing I'm a little iffy on is that, having already materially misrepresented yourself to an immigration officer, if that has any possible bearing on a CR-1 or K-1 visa attempt. I would think it wouldn't even be investigated, though.
