You seem to have alot of proof. Is he sure he answered every question correctly? It seems there was something maybe he answered incorrectly?

they asked him very simple questions and not a lot, so therefore, he knows everything about me since we've been together for so long (6 years)....theres really not a question he couldnt answer...

the lady just gave him a paper that said the request for your visa was denied n highlighted no 5a: "there is no familiar relationship between us"and gave him all the papers since we 1st started the process.

can I ask how was your I-134? Did you need a co-sponsor? if so what is the policy at your embassy about co-sponsors do you have to be related?

I am very sorry for ur situation.

You should have a talk with ur fiance to clarify all details during the Interview (each singe questions and his exact answers). Even before applying to the lawyer you should know all details during the Interview. As u might be know some specific interview details... questions and how he answered.....u know

Now there can be 2 options the 1st lawyer & also might be the lawyer will advice u to make K3 (marriage in the 3rd country, not USA and not his home country but somewhere else where he can go and again apply and wait K3 result around 1 year again Interview and so on but they will not be able to refuse as we are a husband and a wife). Just check if your finance situation is enough to cover the husband foreigner must be not ess than demanded level as the Immigration look at this side very precisely.

If u love each other go head. I wish you to be lucky on this not easy way.

hello everyone, im new here, just got the worst news, my fiance in haiti had his interview for the k1 visa and yes, he was denied....now the lady didnt give him any reason why, he had all his documents, proof, name it, he had them...now were so confused, she gave him back all the petition papers and evrything, what are we supposed to do now????? are they gonna send me a letter stating why they denied him, or should i get a lawyer right away???

I'm sorry :( How often did you visit him in those 6 years? Were they short trips? Because I heard in Haiti, especially after the earthquake, they like to see longer visits or short constant ones to prove a bona-fide relationship. The only thing it seems you can do is to marry him in Haiti and file for CR1. Good luck!

i visited him once after the earthquake, i was there for like 2 weeks, couldnt stay longer coz of my job....but he came to see me last september on his work visa.... now i was wondering, do i have to go to haiti to marry him, or can i have him come in the states and we can get marry here????

Did your fiance tell you if there was one particular thing the CO was concentrating on?

no not one thing...

The small amount of visits could have been the red flags. I think you can get married in the States. However, he cannot stay and AOS there. He has to go back to Haiti. Some people have gotten married on a Work/Visitor visa and stayed in the States to adjust their status, but it is not legal and comes with lots of headaches. And since he already had a denial for the K1, I would recommend doing everything the legal way :)

no not one thing...

This may have something to do with it...what does his immigration history to the US look like? You'll get the best advice if you start from the very beginning and give a rundown of his travels/visas to the US and the timeline of your relationship. Since nothing really seemed to have happened at the interview to cause people here to say "aha, that would be the problem" knowing the full story will help.

Also, any info on family or extended family here in the US??????

AOS is Adjustment of Status... It is the means to actually get a green card. You can read more about it here :)

Maybe they are wondering why you haven't gotten married in 6 years of knowing him? Only being engaged after 6 years might seem like the commitment might not really be there to them. I would marry and go the CR-1 route.
