Hello All,

This is my first post and this is my story:

My girlfriend and I had been living in Colombia with our daughter for 3 years.

I am a US citizen and my daughter has dual citizenship. Maybe I should have

married my girlfriend awhile ago but for whatever reasons I did not.

My mother had already passed without seeing her last granddaughter and my fathers

health was failing. I decided to bring my girlfriend over on a Tourist Visa. She

was sponsored by me and my father.

While here we talked about marriage and I told her it may be not so good of an

idea to come over here and get married on a Tourist Visa. That since we plan on

going back to Colombia in Feb. anyway that we can focus on getting married and a

permanent stay in the U.S.

A week after we talked about that she decided she did not want to be with me any

longer and was determined she would stay in the U.S. without me. Within 2 weeks

she had moved out of our house and in with this man she had only known for 2 weeks

with our 2 year old daughter. By the 3rd week they were engaged and I can only

assume that marriage is to follow shortly. I am sure she has explained to him that

she is running out of time as she is approaching the 180 day mark of her being here

in the US.

I am just wondering what people here on the forum think her chances are of getting

married and being allowed to stay in the US without some kind of red flags or fraud

issues. All I know is that her time expires in April and I think she plans on being

married by then and filing to stay her permanent. I do know she plans to tell them

that she had no intentions in doing all this but that love just happened.

Honestly, i am really sorry for you. Feels like she is doing some immigration scam.

Ouch, that sounds painful.

So you are saying she had just met this guy and they had no communication prior to you all coming back to the states to see you father?

I would think she would still have to go back to Columbia before the visa expires but I certainly do not know all the rules, regulations and loopholes to the visa game.

As painful as this whole thing is I hope you are keeping an eye on the situation, your daughter needs you.

Chances are she will be able to adjust status without any issues.

I think getting approved for AOS is more than likely. Unless there is "proof" of fraud.

In agreement with the other members, I think she actually has more chance of successfully adjusting status while in the U.S. if she marries this random guy she met, than she does if she marries you while on the tourist visa. This is because it is fraud to enter on a tourist visa with intent to immigrate; but it is not fraud as long as she didn't have intent to immigrate when she entered and changed her mind. It is much easier to argue that she did not have intent to immigrate and somehow changed her mind while here, if she got together with someone new, than if she is immigrating through the person who sponsored her for the visa.

Really, at this point I think you should worry less about what she does, and more perhaps about the custody and welfare of your daughter.

You guys are probably right, guess now I can only wait and see how it goes down. Yes, I have turned the focus on my daughter and her safety and security. As I can not see how someome can trust someone around their child like that after 2 weeks of knowing them!

This makes no sense to me, this man (who had a child with the woman) and his father vouch for this women to visit on a tourist visa and now she runs off with another guy and there are no repercussions? This is exactly why honest people find it hard to get a visa and yet there needs to be proof of a scam to to have anything done about it? Why does it matter if its a scam, she came here on a tourist visa and must return before the visa expires whether she marries someone else or not, right? How was it so easier for her to get a tourist visa? She has a boyfriend whom she had a child with, so come on in to America? It seems like that is a red flag right there unless she was the bread winner back in her country. I hope my GF gets her tourist visa just as easy as this lady. And for the record my girl will go back home well before the 6 month expires and we will work on the legal K1 to bring her back.

I am just confused how the red tape actually works when I hear stories like this. So many times I hear stories of people not being granted a tourist visa because they don't make enough money back home or their property or children would not be reason enough to bring them back home. It all seems very silly to me, like there is no rhyme or reason as to how some are OKed while others are rejected.

Well at the moment she is trying to do her best to stay in the country as

yesterday was the day her and my daughter were supposed to return to Colombia

needless to say they didn't make the flight.

So I don't really see her trying to take off with my daughter unless her

attempts to stay her go south.

Another thing is I fount out that her name and Colombian ID have been blacklisted

by Western Union and MoneyGram due to complaints of her promising love to men

getting them to send her money and they leaving them hanging. Matter of fact I

even have tons of proof on this....

Ouch brother, your story goes from bad to worst, no offense. Seems clear the girl is not worth looking for but dang, your daughter! Did you find the local guy she moved in with? It seems lucky you did not marry her, I cant imagine she being the model wife if this is how she is now. Count your blessing and good luck finding your daughter.
