Hi Every one,

I got a notice by checking my case status on uscis website that the i130 application was approved so I am so happy after almost 4 months waiting for that. I am the wife who lives overseas and my husband in the usc.

I would like to know what is the form my husband has to prepare for sponsoring me is it the 864A or just the 864. His mother is my sponsor as he did not have to pay taxes the last 3 years. how long it takes to get the interview??? my consulate is in Paris.

** Moving from K3 Progress Report to CR-1 Process ***

Since you are using the I-13o and do not mention a I-129F, you are on the CR-1 visa path, not the K3.

Your husband is the primary sponsor, so needs to file I-864. He can write a short letter as to why he was not required to file taxes.

His mother should also file a I-864.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for the answer,

Somebody told me that the sponsior is the one who has to file the I-864 not my husband . So according to you and if he has to file that, his mother should file the same one as a join sponsor or how does it work ? I am lost .

My husband works since a year that's why he did not file for the last 3 years taxes .

Please, if you can help me, that would be greatly appreciated.

Your husband, as the petitioner, is ALWAYS the primary sponsor. Even if he made no money at all, ever.

Then his mom is the joint sponsor so yes, a I-864 for each.

Hi, I had a related question to this, when writing a letter in the I864, stating why we dont have to file taxes, do we have to include evidence? I worked, but I worked abroad, and recieved a very little paycheck. Thats why I didnt file my taxes.

Unless you only made a tiny amount, you were still required to file (not PAY, just file), and it might be easier to back file for the last three years rather than write an explanation. They don't usually ask for evidence, unless they are suspicious (for example if you travelled a lot or lived in an expensive city and state you made no income at all, how could you afford that).
