Hello all,

From your experience, do you think that an IR-1 get approved quicker than a CR-1?

I've been trying to get a rough estimate as to when we could get our IR-1s approved and the majority of the cases I have seen (correct me if I'm rong) are CR-1s.

USCIS (49 days) NVC (42 days)

02/06/13 I130 sent 04/12/2013 NVC received file

02/08/13 I130 delivered to Phoenix Lockbox 04/23/2013 Case numbers assigned and DS3032 emailed

02/13/13 NOA1 04/29/2013 Cases finally linked for AOS payment - paid straightaway

02/13/13 Fees cashed on 05/02/2013 DS3032 accepted
02/16/13 I797 received (pd 02/08/2013) 05/03/2013 AOS packages sent
04/02/2013 Available on USCIS website 05/03/2013 IV fee paid
04/03/2013 NOA2 05/04/2013 AOS status 'PAID'

04/08/2013 Paper NOA2 received 05/06/2013 IV package sent
05/08/2013 AOS and IV delivered to NVC
05/17/2013 Expedite request filed

05/21/2013 IV Package approved (9 bus. days)

05/22/2013 AOS on hold (new version used)
05/24/2013 Expedite approved by Paris Embassy (docs shipped on same day)

They are the same visa.

The only difference is the green card you end up with in the end.

If you've been married for 2 years or more at the point of entry into the US, then you get IR1 10 yr green card.

Less than 2 years? 2 year conditional green card.

Married June 2010?

You are IR1.

Ugg. They are not the same visa but the process of obtaining them is exactly the same so the timeline is the same too.

Thnaks very much KHD.

I knew I as IR-1 but I thought that maybe IR-1s would be a little quicker as by living together for over 2 years without attempting to get a green card could prove that I did not get married 'just for the GC'.

Don't get me wrong, I am NOT saying that all CR-1s do, simply that I thought IR-1s would be a little quicker.

Anyway, it's all clarified thanks to you :)

No, they could care less.

We were married in Oct 2011.

it just depends where you are filing....I send my package to Chicago lock box, later the case was transfer to MSC, and it only take 44 days approved our application.

We sent ours to Phoenix AZ Lockbox as soon as my husband arrived in the US on 06/02.

Do specific Lockbox get transferred to specific Service Centers or is it potluck?

No, they could care less.

When you don't know, it's better to wait until somebody who DOES know comes along. IR1 and CR1 are both visas and resident status categories. You can receive a CR1 visa, then depending on your entry date relative to marriage date, receive IR1 status upon entry.

When you don't know, it's better to wait until somebody who DOES know comes along. IR1 and CR1 are both visas and resident status categories. You can receive a CR1 visa, then depending on your entry date relative to marriage date, receive IR1 status upon entry.
