Hello,

I have a question regarding dependent tax filer. My fiancee wants to apply for me to come to the United States using the I-129F visa. My question is, because she is filing her 2012 taxes for the first time as a dependent filer with her father, can we use her tax file as an primary sponsorship? and use a relatives (not fathers) tax file for co-sponsorship? Will her tax file provide enough evidence? Will we need her father's documentations/approval or only hers will be sufficient?

Your question makes absolutely no sense and I suspect its because you do not understand the tax system in the US.

You say your fiance is filing her 2012 taxes for the first time as a dependent filer with her father. Thats an incredibly odd thing to say. How old is your fiance? Whose taxes was she on before then? Did she file her own return before then? None of those questions really matter. Its just an odd thing to say. Typically up until youre 18 or are a full time student youre claimed on a parents taxes and then you start filing your own tax return. So for you to say 'this is the first time shes being claimed by a parent' is very very odd. But its irrelevant.

If shes a dependent on someones taxes in 2012 and did not file her own return in addition to being listed as a dependent (because she had no income or her separate return shows very low income) then she can still file a 129F petition if she meets the criteria to file one. (Shes of legal age, youve met with in the last years etc.)

Youre going to need a co-sponsor for the 134 aff of support as your fiance wont qualify on her own. Shed either have to provide a statement saying she did not file a tax return for 2012 as she had no income and was someones dependent or provide her tax return that she filed in addition to being listed as a dependent of her fathers showing her low income. The co-sponsor can be anyone- it doesnt have to be the father.

However if she was a dependent on someones taxes in 2012 and did file her own tax return because she did have income and her income is sufficient to meet the poverty guidelines then you can use her tax return. Her tax return will just show a box checked that says- someone can claim me as a dependent on theirs, she wouldve paid a higher tax rate. But if her incomes enough, no co-sponsor would be necessary.

Not really clear about your question, But here is the deal:-

If she wants to apply for you as a K1 visa, she has to sponsor you with I-134. In I-134 she has to meet income guidelines. For Bangladesh Embassy, They DO NOT ACCEPT Co-Sponsor in case of K1 visa. Either she has to make enough income or have the asset to qualify the requirement by herself. If she started earning money in 2013 that is sufficient enough than she have show proof 2013 earnings statements, letter from employer etc.

If she can't meet the income guidelines by herself, your option is to get married and file for IR1/CR1 visa, which accepts Co-Sponsor.

If her current income meets the requirements, then no cosponsor is required. Besides tax transcripts, she needs to provide copies of the latest pay summaries, possibly a letter from her employer stating her annual salary. If her father is also needed as a cosponsor, then he needs to also provide the same documentation.

From my understanding of this, she filed her own taxes but indicated someone else is claiming her. You can file taxes this way until you are 24 if you are in college. I started filing when I was 16 since I had a job, and they took taxes out of my pay. I just had to indicate that someone else was claiming me as a dependent. Since my income was low, I just got all my taxes back, and my parents benefited from the credit.

It's not really relevant though, all that is relevant is how much she made.

Fiancee's age: 18

Status: US citizen ( college student)

Tax file: Filing taxes for the first time for 2012

She worked in the summer of 2012 and received a 1098 form. Before this, up to the year of 2011, she was with her father because she was not 18 years old and therefore could not file taxes on her own. Since her income is low, her parents are also claiming her. Our question is can she use this tax file that she is filing as a primary sponsor to apply for the I-129F visa for me without using her father's documentation?

Also, some people are saying that Bangladeshi Embassy doesn't accept co-sponsorship for K-1 visa. Is that true?

I dont see anything that states that embassy does not accept co-sponsors. You would need to contact the embassy and ask about their policy about accepting co-sponsors for fiance visas. Some embassies allow for co-sponsors, some do not.

(There is only one review posted on here about that embassy. In it the user did have a co-sponsor for their fiance visa- http://www.visajourney.com/reviews/index.php?trim=no&cty=Agana%20GU&cnty=Bangladesh&page=1&dfilter=2&topic=K1%20Visa - it was from 2010.)

You can find the embassy contact info on their website here- http://dhaka.usembassy.gov/immigrant_visas.html

For your fiance- they will want to see her tax return- that means the return she filed- not the tax return where she is listed as a dependent, but the one with her name on the top. They will also want to see her current proof of income (pay stubs, employment letter). If her income is sufficient- no co-sponsor. If its not, she will need a co-sponsor.

The co-sponsor will fill out a form and show their tax return and proof of their income.

Also if you find out from the embassy that they DO NOT ALLOW for co-sponsors for fiance visas and your fiance does not meet the income requirements, then she can not get the fiance visa right now. She would have to wait until she has enough income to be approved, or you would have to get married and apply for a spousal visa because co-sponsors are allowed for spousal visas.

The person that stated they do not allow co-sponsors has already gone through the same embassy you will, so perhaps they have experienced knowledge on the information they gave. You can always email the embassy and ask them yourself.

Your fiancee will provide a copy of her own tax return, not the one from her parents. She needs to earn enough for the two of you, as of now it is $18,912 for a household of 2. She will provide a letter from her employer and most recent pay stubs to prove her current income. If they allow co-sponsors, then her father would provide his own I-134 form, a copy of his most recent tax transcript(which will show she is a dependent of his), letter from his employer and most recent pay stubs. He also needs to provide proof of being a USC or LPR.

If she does not earn enough by the time the I-134 would be needed, and they do not allow co-sponsors, then you would need to withdraw the petition, get married and start over filing the CR-1 for a spousal visa instead. A joint sponsor is accepted for the I-864 used for a spousal visa.

If your consulate allows a co-sponsor, it can be any USC or LPR.

Make some serious research about that.

1)Not all embassies will accept co-sponsors. This is an embassy specific matter, check into the bengladesh forum, read the bengladesh portal, go ask that question in the regional sub-forum and gather info!

If long lasting members from VJ who went through bengladesh embassy tell you they don't accept co-sponsor, then, they probably don't...

2) When embassies accept co-sponsor, some may still refuse your co-sponsor if the main sponsor's (your fiancée) income is too low (http://www.visajourney.com/forums/topic/402790-k1-visa-denied-public-charge-pretty-outraged/)

If your embassy refuse co-sponsors, the only ways are

1) your fiancé gets a job with sufficient so she meets the poverty guidlines

OR 2)get married, fill for CR-1, and then all embassies will accept co-sponsors. Check very carefully the requirements for co-sponsors though, ties to the USC fiancé must be pretty important I think... so I'd advise you to do some more research if your going that way.

One last thing, she needs a steady income. For K-1, tax returns are not officially required but paystubs are. The CURRENT income is what matters. So a summer job WON'T work.

finally i have found a topic where i think i can get an answer.

So my fiance is from Bangladesh. I know they don't accept co-sponsor for K-1 visa. Last year i was dependent on my parents and did not have any income. Starting January 2014 I have been working at a CPA firm and I make enough to sponsor my fiance. But my concern is, since I did not have any income last year and so there is no tax return filed by me, what should i do to cover that? should i write a letter and explain. Will that be a issue to get Visa?
