The 1040 is just a longer version of the tax form. People who do not need to itemize things on their taxes can file a 1040EZ. It's just shorter, but the consulate should not have a problem accepting that one if that is what your fiancé has. My fiancé submitted copies of my 1040EZ forms from the past couple of years and there were no problems. Granted, this was the Guatemalan embassy, but Manila really should not have a problem with this form.

I am sorry that Manila does not accept co-sponsors for the K-1. But I think that as long as you can provide verified documentation of your fiancé's income, you should be able to move forward with your visa process.

Met June 2009, Carlos returned to Guatemala in March 2010, engaged May 2011, hardship waiver, denial, three years of separation, second waiver, APPROVED!, finally back in the U.S. in May 2013, married June 2013, permanent resident January 2014, and at long last, a citizenship on October 17, 2019.  Our immigration journey has finally come to an end!

re: income for 2012.

Surely he can prep a 2012 income tax return, complete with a schedule C?

if not that, then an audited quarterly profit and loss statement, prepared by an signed by a CPA, should suffice, for 2012.

Hi everyone

i just wanna ask if there's a little chance that i will get approved after i receive the 221g form?

Is there any deadline for me to submit the doc they're asking which is evidence of current sustaining income? They're actually asking to submit some payslips.. Anyways.. Here's the story:

During the interview i have proved the genuity of our relationships but what caught the consulate attention is the ITR and W2 form that my fiancr gave them it was from his prev. Job last 2010-2011

But his current job is lic. Tattoo artist and shop manager and his kind of work falls under self employed that's why he doesnt have a paystub to prove that he is earning.. But the consul insisted during interview that i he should have a paystub or else his work is illegal. I told her how can he have that if his customer pays him directly?

Then the consul told me that is illegal but i told her how come its illegal when he is a lic. Tattoo artist and he has a business licenced as well

The consul just told me that my fiance should find another job that issues payslips and said sorry she will hold my visa until i submitted those payslips..

Is there any deadline for that? Bec. There's no written deadline on the form and they didnt advice me when should i submit those docs that she is askng?

We are planning to comply all payslips on May. How many payslips should i give them? 3 is good enough? My fiance had applied for one more job aside from tattooing and he will start on first week of feb thats why im askng if theres a deadline so we can save atleast 3 payslips until May..

Aside from the payslips we would like to add his 2012 ITR as self employed

Waiver from his previous customer which indicates how much they have paid him

A copy of tattoo shop bussiness licence and his licence to prove that his nature of work is not illegal

Copy of the deeds that he own a house bec the consul ask me if he has property then when i ask her if i cud also send a co-sponsor affdvit of support which her mom since she was also lives under one roof she didnt accept it and again

she ask me why my fiance is living with his parents i told her no.. They are the ones who is living with him.. He owns the house but again the consul doubted my fiance's capacity to support me. Then she told me that the house cannot feed me etc.. She insisted that my fiance finds a descent job and hav his payslips submitted to them..

I was so hurt that she is tryng to say that being a tattoo artist is not a descent job.. :(((((

just wondering in regards to the income of the petitioner (I know theres a certain amount you have to make to be able to support the beneficiary too I think it has to be more than 15 or 16k yearly not exactly sure) but my question is the embassy in manila looking for a certain abount $$$ the petitioner has to make a month so they can say you can support the fiance while shes not working or theyll just look at the W2?

Asking because our interview will be at the manila embassy too.

Actually i submitted a co-sponsor affdavit but still she didnt accept it.. She still want me to submit my fiance current sustaining income..

May i ask you something? Do i need to submit that asap? Is there any deadline?

I can submit that on May.. Bec. My fiance will just start his another job dis feb..

Hi Girl, sorry just have time to read your post again. I think at least three months current payslips would be fine...that will show current sustaining income. Gather all income documentary evidences. Did you submit a copy of your Fiance current tax payment? I really hope and pray that soon you would get your visa approved. Please don't lose hope, there is a way to your problem. Just keep focus on preparing the needed requirements and pray to God. (F)

Well that's the consul told me when i presented the co-sponsor affdvit... And she told me that they are not accepting co-sponsor for k1 visa.. Lucky for those k1 visa filer that the consul who interviewed them is considerate.. Mine is not.

That's all.. I'm so tired right now and feel devastated...

You fiance neds to file his quarterly taxes, and he needs to submit his tax transcripts from filing. As self employed he does not get paystubs. Also, to inform ou when he files his taxes, they look at it differently than someone else, if his AGI is less than the reuirement than you will be denied.

For those petitioners who work for an employer, generally speaking, the U.S. Embassy Manila (USEM) looks at these things:

> The current income tax return: Until April 15, 2013, the current income tax return is the 2011 income tax return. After April 15, 2013, the 2012 income tax return will be required. However, it's OK to submit the 2012 income tax return before April 15, 2013.

> The current W-2: If the petitioner works for an employer, the employer is required to send the employee a W-2 wage statement by January 31. The W-2 wage statement, among other things, shows the employee's gross income for the previous year. For 2012, the employer must send the wage statement by January 31, 2013. When the employee receives the 2012 W-2 wage statement, then the employee can file their 2012 income tax return (1040/1040A/1040EZ). For the USEM, until April 15, 2013, the current W-2 is the 2011 W-2. After April 15, 2013, the current W-2 will be the 2012 W-2. However, it's OK to submit the 2012 W-2 and the 2012 income tax return before April 15, 2013.

> Current paycheck stubs: The current paycheck stubs are important because, as you can see, a 2011 income tax return and a 2011 W-2 is not going to be helpful to the consular officer in determining the petitioner's current sustained income. A 2012 income tax return and a 2012 W-2 is more helpful, but it's not enough. The consular officer wants to know what the petitioner's income is today. Current sustained income is how much income the the petitioner makes at the time immediately before the interview. When a consular officer looks at the current paycheck stubs, they can determine how much income the petitioner is likely to make in 2013. The projected income for 2013 needs to exceed 125% of the poverty guidelines for the petitioner's household size.

The official poverty guidelines are just there.

> Employer's letter: It's helpful to submit a letter from the petitioner's employer. The letter can state the basics, such as the petitioner's hourly wage or salary, their length of employment, etc.

@MeggieStevie: Since your petitioner is self-employed and probably receiving mostly cash for his work, he needs to find a way to document his current income. You have a good chance of visa approval if you can submit documentation of his current sustained income. If I were in you shoes, I would also submit his 2012 income tax return and his 2012 W-2 (if any). I would also submit his 2012 tax transcript.

I would also submit an I-864 and it's supporting documents from his joint sponsor. Manila may say they don't accept joint sponsors for K-1'ers, but they actually do accept them maybe 50% of the time. It wouldn't hurt your case to include the joint sponsor's papers along with the other documents.
