For those filing from abroad (or who have knowledge about it) and I-864

Am I correct that I need to fill out an I-864 and NOT an I-864A? I spoke with USCIS and the rep told me that because I am not living in the US, and not living with our co-sponsor that I need to fill out I-864 and so does the co-sponsor. NOT the I-864A. The guy I spoke with had an attitude so I want to get a second opinion from someone who has experienced this.

I currently reside abroad with my husband, have been in Canada for 5 years - I am a stay at home mom right now, expecting our next baby in March. I am not earning any money, I have no job lined up because I'm preparing for our baby. Is that going to hurt me since I can't show any financial support? Obviously the reason needed for a co-sponsor. Just wondering if it's ok that I don't have anything. No assets, either. We live debt free, but don't have a house, fancy car, anything that we could turn to cash.

The plan is for my husband to find work once he is approved and we move out there together. We will live with my dad until we get off our feet. My dad will likely be the co-sponsor.

I guess I thought the I-864 was only if the petitioner has died. I really want to make sure I'm doing this right. USCIS told me they can't give info on when to send this form, or whether or not my co-sponsor and I should send them together, etc....so what the heck am I supposed to do? He also said the NVC doesn't take phone calls - so I have to write them a letter to ask questions?

If anyone else has been through this situation please give some wisdom. Thanks :)

The I-864a is if you are currently residing in the same household as the sponsor, so someone still living at home with their parents(who are co-sponsoring), for example.

You and your father both need to fill out I-864 and submit them both with the AOS package at NVC. Have you read the guides related to NVC and paperwork submission there? You need to do that. Like, yesterday.

You shouldn't have any problems since you don't work as long as your father makes enough to support his dependents as well as your husband. Read the instructions for the I-864.

I'm also in this same situation. So let me get this straight. I, the petitioner and sponsor, am CURRENTLY living in the Philippines. My Filipino husband and I plan to move to Texas together to reside with my mother. My mother will be a co-sponsor to fulfill the income requirements for the AOS. Therefore, I need to fill out I-184 AND my mother needs to fill out I-184 (NOT I-184a) because we are CURRENTLY NOT LIVING IN THE SAME HOUSE. Do I understand this correctly? Thanks.

Also, since my mother's I-184 and my I-184 both need to be sent to NVC together, is it possible for her to scan her I-184 with her signature, email it to me, I print it out, and send her form with my packet to NVC? Sorry if that's a silly question. I'm new to this VJ thing... :blush:

For the address on the I-184... since I'm currently living in the Philippines, should I put my mailing address as my current Philippine address or my address in Texas where I WILL live? When I filed my I-130 I initially put my Philippine address for my own, but then the USCIS clerk told me to change it to my (previous) mailing address in the States. At the time of filing the I-130, we weren't sure where we would be staying so we just put my grandmother's address. But now- after the I-130 approval - we've decided to move in with my mother. SO WHICH ADDRESS SHOULD I PUT ON MY I-184??? My grandmother's (to match I-130)? my mother's (where we plan to live) or Philippine address (where I'm currently at)? :wacko:

I would put the US address you intend to live, as the petitioner is supposed to be domiciled in the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

However, I believe you have to turn in all originals at interview, yes?

So I guess you still have to mail it anyways.

So it appears that my mother would need to physically send the I-864 (don't know why I keep putting i-184??? I guess my brain is scrambled with all this.. he he). Since I do need the originals at the interview, best to just get the form, with her original signature and supporting documents. Thanks so much for the advice. :)

Are you suggesting mailing things to the NVC while doing EP?? If so, then that's not correct, when doing EP, nothing is mailed to the NVC.

Thank you! I have started reading about it - am I the only one that find it a little overwhelming? I find I have to read it twice through to get everything. :blink:
