Hey,

I'm confused as to whether I should apply for K3 or IR-1/CR-1. I currently live and work in the USA on an E2 Visa. I am getting married to a US citizen next month and don't know which to apply for. The IR-1/CR-1 seems to be what I need in the long run but does anyone know if you can apply from inside the US or do you have to be living abroad?

You have to file IR-1/CR-1 (form I-130) before you can file for K3 (form I-129F)

You need a copy of the NOA1 from sending in the I-130 to file with your I-129F for K3.

Just a heads up, K3 is basically useless now. It's very rare for someone to get approved for K3 over their CR-1/IR-1. K3 is basically obsolete.

But, since it doesn't cost any extra money (other than shipping/postage), you might as well file it anyway. I did.

You wouldn't apply for a visa, you would apply to adjust your status to Permanent Resident. The process begins by concurrently filing an I-130 and I-485. Read the instructions for both forms on the USCIS website and also read the VJ guide which I linked to below.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Are you allowed to adjust status from an E-2 visa?

If so, ditch all ideas about pursuing a visa and chase after adjusting status, instead.

If not, then pursing the CR-1 visa , with final processing back at the country where you hold a passport.

My bad, I totally missed the part where they said they are in America already.

So yes.. I-130 and I-485 is your option.

If you are already legally living/working in US, you don't apply for K3 or IR-1/CR-1. You just AOS once you are married by filing the I-130 & I-485.
