Initial Review

On December 17, 2012, we received this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

my wife got a recipient number and when i checked here (Check My Case Status) in the official uscis website i got what is mentioned above......?????

Thank you for completing a timeline. Your timeline indicates you filed an I-130 petition. Your opening post indicates you are waiting for a case number. Above, you quote a status for an I-765, not an I-130. Are you sure your wife filed an I-130?

Where are you? Are you in the USA currently or living in another country. Which country?

After several indications that your wife needs to login here and tell us what she actually filed and when, she has not done so. We are trying to help you. Please help us help you by either you or your wife answering the above questions as directly as possible.

OK. You got to stop with the speculation and actually answer the questions. If you don't know, ask your wife or ask her to come here and answer. This form is NOT relevant. We really can't provide any meaningful assistance without reliable information from you or your wife.

The only things apparent to me, is you and perhaps your wife are totally confused and at least one irrelevant form has been filed.

Facts are cheap...knowing how to use them is precious...

Please take the time to answer all the questions that have been asked here. If you don't have the patience and dedication to do that, then yes, you should hire professional help. When you do, the first thing they will do is start asking you these same questions though. Why not start by answering them here?

I believe your wife has an incorrect receipt number or she turned in something she should not have. If you are living in Algeria and she filed an I-130 to start your CR1 process to come to the US an I765 Employment Authorization is not needed or filed. She should call the USCIS and verify the receipt number and talk to someone to find out if they did in fact receive an I-130 packet at all. :blink:

ok so I was a little behind here... story of my life!!! Ha!

Wendy, you will need to call the USCIS and wait however long they put you on hold. It is completely necessary at this point and it will be worth your time. Honestly this waiting time is very minimal to what is ahead. If you have the patience and do the research a lawyer is not needed at this point. We never used one. But you have to be willing to wait on hold, mail in what is asked for, fill out the forms, etc. A lawyer will do it for you but as mentioned previously... they will still need all the paperwork and answers.

You should have only filed the I-130, two G325a forms, and potentially a G1145 which would have given email or text updates on the case. Hopefully you submitted the correct supporting paperwork.

I suggest you call and wait the 40 minutes or more on hold to speak to an ISO and they can advise you on how to fix this. I think it might include withdrawing the I-765 and making sure that they don't think your spouse is currently in America and trying to adjust status.

ok - so there is no basis to file for an EAD.

Since you filed for one, yer getting a rash of notification about it.

I suggest calling in to USCIS, Wendy, getting an ISO, and getting this fixed.

When you call ask to speak to a "tier 2 immigration officer". The person that will answer the phone will not be of sufficient help.

Compare it to what you actually send in, come back and list it here.

Read the guides and understand the process and you won't need a lawyer. This is just the beginning of a potential wild roller coaster ride so make sure you study the guides, especially for the NVC phase.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
