Visitor visa while k1 pending

Hello everyone,

I am just wondering if anyone can help. I received my NOA2 approval on Dec. 10th after almost a seven month wait!! Things are not looking like they will be moving smoother for us either cuz till now NVC still hasn't received our case. Now my concern is that my fiance has an Pharmacy exam he should be taking next April 2013. It's only offered twice a year. So if, God forbid, he misses this one, he won't have another chance to take it till maybe Nov. 2013.

I was wondering if it maybe possible for him to enter USA on a visitor visa just in case we don't get an approval before April. Do you think he maybe approved for a visitor visa with K1 visa pending if we explain why he needs to enter USA? Will this affect the K1 visa processing?

Any input will be helpful. Thanks a lot!!

If his visitors visa is denied, it will not affect the fiance visa interview

what country is the beneficiary from?

He should bring strong ties to his home country, reasons to visit the US are not important, reasons to return home are

Strong ties like what? Any ideas how long a tourist visa takes to get approved?

Administrative processing through Egpyt is commong for both immigrant and non immigrant visas.

Ties include a job, property, bills, family, etc. Anything to show that he MUST return

Visitors visa from Egypt with a pending K1 case may be difficult to get, but if you have the money to apply, may as well give it a try- as mentioned, a denial will not affect the K1 visa.

Keep in mind that even after your fiance enters on his K1, you need to get married and then apply for AOS and a work permit, so it will be several months until he can work as a pharmacist. He could take the exam during that time, too, as it is offered every 6 months.

So does that mean he can't work anything at all? I know it will be several months till he can work as a pharmacist since he has to take more than one exam. But, can he work while he's studying or does he have to wait several months like you mentioned? thanks a lot!

He won't be able to work at all. He'll need at least the Employment Authorization Document (EAD) and Social Security Card/Number before he's legally eligible to work in the US. You can file for the EAD at the same time as the Adjustment of Status.

About 3 months for EAD so he can work, 6+ months for the actual greencard
