Right to a fair trial or we are just being treated like second-class citizens?

The 6th Amendment in our constitution gave us the right to a fair trial and to “…enjoy the right to a speedy and public trial…” It means; short time, so we don’t waste our lives just waiting… and it also means; transparency... so the government can’t create a process without any accountability for its actions…

The only process that comes to mind is at Guantanamo bay, where you are on this island for an unknown amount of time, and have no right to ask when, or if you can leave this place… So, why USCIS treats us like terrorists? First, let’s see what is wrong with the process:

USCIS charges $340 for the application. So, if you charge the citizens then you are also accountable of how you spend the money and if you are providing the services required for it. Also, with unemployment around 8%, why not hire more employees or consultants to reduce the wait time down to a month? Can you charge a premium for an expedited service? Is the Director in charge of load-balancing the work between the different centers being questioned about having one center’s processing time double the others? Are you going to fix your website that is always 2 months behind and having to go to private sites (like visajourney) to get more accurate information? Are going to fix your call center to give some more accurate information about our cases instead of reading to us what we see on your website? Are you working on improving your agency’s image that is only second behind the IRS for obvious financial reasons? When are you going to be accountable before your customers? How can we protest your slow and unfair process? I want to be able to take you to court, if I see that you are not doing your job… how?

Please ask yourself; could any employee of USCIS take an unpaid leave for unspecified time, without the ability to look for another job? If you can do that… we can wait…

Immigration isn't a trial... you have not been charged with a crime.

It is not a trial, but it is a very similar progression … USCIS acts like a judge who determines your future… the differences are you don’t have a trial date, you can’t protest, and there is no higher court to go to… USCIS have created a process where they are not accountable for anything… and they answer to nobody…

You're comparing apples to oranges.

A better comparison would be applying for college. You file the paperwork and you wait to see if you're eligible. If you are, GREAT, if you're not, denied. The colleges don't necessarily give you a timeline for when they'll review your paperwork, you can't call about it, you just wait. You submit what is asked of you, and you wait.

Your partner/spouse has no rights to immigration to the US. Neither do you have the right to bring them over whenever you want. There is an application and vetting process. Yes the wait sucks, but we all do it.

Yeah, they're doing what they can I suppose. I sent in all of my info along with an explanation of it and I received an email from one of the employees yesterday telling me that my case was with an adjudicating officer and I should have an answer within 30 days. I asked them to put in another email asking the officer if I could send in my missing packet info and they did that as well. Still waiting on that answer, though.

It wasn't really what I was hoping for, but I know they legally can't force uscis to expedite anything. So basically it's just more waiting.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.
