HELLO, I am ready to file my AOS very soon. I have an European passport from my home coutry.Is it requred to have new passport or they just want to see how many visas end entries have in US? Wondering if I can file( making copies only of) my recent passport which is expired 6 mo ago. Greatly appreciate any help...

If I am not mistaken, you need to have a valid passport for at least 6 months when you apply for a green card. The old passport is also necessary to show the USCIS that you entered legally to the USA.

I was in a similar situation before I filed my AOS. The Polish consulate gave me an option to get a temporary passport, valid for 1 year, in about a week. Check with your consulate if they have this option

Hello back on passport question. Called my embassy they only want to give temporarily passport with a validation of 6 mo not longer. That one would only be valid for 6 mo from the issuing date. Probably wuldnt be less than 6 mo when it hits Immigration office.the other option is the 6-8 weeks prepared 5-10 year old passport. The only thing I can order it and send them receipt at the ordering that is been ordered... Also having difficulty with travel document part 7 if Aplying for advance parol . Do I need to explain on a separate paper why I qualified for that?also # 1 asking for how many trips I intend? A) one b) more than one trip. Could that be more than one??? Please let me know if u can answere to this?? Million thanks

No need for an explanation when filing the I-131 with the I-485 for advance parole. Check for more than one trip. It is valid for multiple uses while waiting on your green card.

Also, you just need to send the copies of your visa, entry stamps and I-94 with the AOS paperwork. It won't matter if your passport is now expired. You can still file now. You will obviously need a valid, unexpired passport to use the AP and your green card to travel with though.

You have no timeline. What visa are you adjusting from?

What Harpa said is correct: you absolutely need:

1) the old passport with the visa and the entry stamp, and

2) the stapled i-94 in it.

What you do not need is a new passport. In fact, you don't even need a new passport when you have your Green Card. The only reason for you to get a new passport is if you want to travel internationally before becoming a US citizen.

You do NOT need a valid passport to file AOS. That is wrong. The old one you have is just fine.

I just want to ask you a off topic question. Can I have my medical exam done with expired passport ? Will civil surgeon ask for a valid passport ?

The civil surgeon will just need an ID from you. Is the passport your only ID? If it is, then use it anyway.
